Public Notice

The Treaty of Waitangi Act 1975
The State-Owned Enterprises Act 1986

This notice concerns land at 1 Alfred Street, 3 Alfred Street and 9 Alfred Street, Palmerston North and Maori claims under the Treaty of Waitangi Act 1975.

The land at 1 Alfred Street, Palmerston North, is described in legal terms as “All that parcel of land containing 341 square metres, more or less, situate in the City of Palmerston North, being Lot 3 on Deposited Plan 72251 and all the land comprised in certificate of title 41A/468 (Wellington Registry)”.

The land at 9 Alfred Street, Palmerston North, is described in legal terms as “All that parcel of land containing 387 square metres, more or less, situate in the City of Palmerston North, being Lot 1 on Deposited Plan 72251 and all the land comprised in certificate of title 41A/466 (Wellington Registry)”.

The land at 3 Alfred Street, Palmerston North, is described in legal terms as “All that parcel of land containing 341 square metres, more or less, situate in the City of Palmerston North, being Lot 2 on Deposited Plan 72251 and all the land comprised in certificate of title 41A/467 (Wellington Registry)”.

The lands were once owned by the Crown. They were transferred to a State-Owned Enterprise under the State-Owned Enterprises Act 1986.

There is a special notice or “memorial” on each of the certificates of title for each parcel of land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owners of the lands are:

  • Numbers 1 and 9 Alfred Street, Palmerston North - KENNETH DOUGLAS THOMPSON, JACK KENNETH THOMPSON, JOCELYN FRANCES THOMPSON and FRANCIS JOHN LIGHT.

  • Number 3 Alfred Street, Palmerston North - JANE MARY REINHARDT.

The current owners have applied to the Waitangi Tribunal to have this notice removed from their respective lands.

This has been done under section 8D of the Treaty of Waitangi Act 1975.

ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT ALL OR ANY OF THESE LANDS, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 18TH DAY OF JUNE 1998.

Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims should be posted or sent to the Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington.

If no claim about all or any of these lands is made to the Waitangi Tribunal before the 18th day of June 1998, then the Tribunal may recommend that all or any of the lands no longer be liable to be resumed by the Crown and returned to Maori.

Dated at Palmerston North this 16th day of March 1998.
