Additional Rights and Conditions Included in the Easement

1. The rights and powers implied in easements of right of
   way, pursuant to the Ninth Schedule to the Property Law
   Act 1952, and the Seventh Schedule to the Land Transfer
   Act 1952, shall apply to the easement referred to herein as
   modified by the conditions contained herein.

2. The grantee shall compensate the owner for any proved
   loss or damage caused by the use of such right of way.

3. The right of way shall follow a route to be agreed upon
   between the grantee and the owner and shall be maintained
   by the grantee to an all-weather standard at its own expense.

4. The owner shall have the right to use the said right of
   way at all times.

Pursuant to section 20 (1) of the Public Works Act 1981,
the Minister of Lands, declares that an agreement to that
effect having been entered into, the land described in the
Schedule hereto, is hereby acquired for road, which
pursuant to section 60 (2) of the Transit New Zealand Act
1989, forms part of State Highway No. 3 and shall vest in
the Crown on the date of publication hereof in the New
Zealand Gazette.
