Setting Apart Maori Freehold Land as a Maori Reservation

Pursuant to section 338 (1) of Te Ture Whenua Maori Act 1993, on the recommendation of the Maori Land Court, the Maori freehold land described in the Schedule hereto, is hereby set apart as a Maori reservation for the purpose of a recreation area and mahinga kai, to be known as Te Komiti 22C for the common use and benefit of the owners and the former Te Komiti 22C block.

Public Works Act 1981

Land Acquired and Easement in Gross Acquired in Rotorua District

Pursuant to sections 20 and 28 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for road and an easement in gross to drain water as described in the Second Schedule hereto, is hereby acquired over the land described in the Third Schedule hereto, and further declares that the said land and easement shall vest in The Rotorua District Council on the date of publication hereof in the New Zealand Gazette.

63 square metres, situated in Block I, Tarawera Survey District, being part Lot 12, D.P. S. 2138; as shown marked “A” on S.O. Plan 60595, lodged in the office of the Chief Surveyor at Hamilton.

Second Schedule

Description of Right to Drain Water Easement

The rights and powers implied in and attaching to a right to drain water easement as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right to Drain Water”, together with the additional rights contained in paragraph 5 of the said Seventh Schedule, as if the same were fully set out herein, provided that the word “Council” is substituted for the word “grantee” therein, and provided that the council may discontinue or recommence such uses at will.

Land Over Which Easement is Acquired

All that piece of land situated in Block I, Tarawera Survey District, being part Lot 12, D.P. S. 2138; as shown marked “B” on S.O. Plan 60595, lodged in the office of the Chief Surveyor at Hamilton.

Pursuant to section 20 of the Public Works Act 1981, the Minister of Lands declares that, agreements to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for road and shall vest in The Western Bay of Plenty District Council on the date of publication hereof in the New Zealand Gazette.
