Road Realignment—Marfell’s Beach Road, Marlborough District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, R. J. Sutherland, Land Information New Zealand:

(a) Pursuant to section 20 (1), and to an agreement to that effect having been entered into, declares the land described in the First Schedule to this notice to be road and vested in The Marlborough District Council, on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to sections 116 (1), 117 (3) and 120 (3), declares the portions of road described in the Second Schedule to this notice to be stopped and amalgamated with the land in certificate of title No. 5A/225, subject to mortgage 169770.3, section 3 of the Petroleum Act 1937, section 8 of the Atomic Energy Act 1945, section 3 of the Geothermal Energy Act 1953, sections 6 and 8 of the Mining Act 1971, sections 5 and 261 of the Coal Mines Act 1979 and Part IVA of the Conservation Act 1987.
