Declaration by Chief Electoral Officer That Helen Duncan be Elected a Member of Parliament
On Tuesday 24 November 1998 I received a warrant from the Speaker of the House of Representatives to supply a member of Parliament to fill a vacancy created by the resignation of Jill White.
Pursuant to section 137 (2) of the Electoral Act 1993 I have determined that Helen Duncan was the next unelected candidate whose name was included in the same party list as the member whose seat has been declared vacant and that it was Helen Duncan’s name which stood highest in the order of preference.
Pursuant to section 137 (3) of the Electoral Act 1993 I have inquired of the Secretary of the political party on whose list Helen Duncan’s name appeared whether she remains a member of that party and I have been informed by the Secretary of that political party that Helen Duncan remains a member of that party.
Pursuant to section 137 (4) of the Electoral Act 1993 I have inquired of Helen Duncan whether she is willing to be a member of Parliament and she has indicated her willingness to be a member of Parliament.
Therefore, I, Philip Raymond Whelan, Chief Electoral Officer, declare that Helen Duncan is elected as a member of Parliament.
