Dumping and Countervailing Duties Act 1988

Notice of Review of Need for Continued Imposition of Anti-Dumping Duty on Refined Sugar from Belgium, Denmark, Germany, the Netherlands and Thailand

I hereby give notice that, pursuant to section 14 (8) of the Dumping and Countervailing Duties Act 1988 and section 186L (5) of the Customs Act 1966 (as inserted by section 2 (1) of the Customs Amendment Act (No. 3) 1987), I have initiated a review of the need for the continued imposition of anti-dumping duty on the goods described in the Schedule to this notice. Anti-dumping duty was imposed by the Minister of Customs in relation to the countries of origin of Germany and Thailand by notice dated 9 November 1988 published in the New Zealand Gazette of 10 November 1988 and reassessed in notices dated 22 February 1990 published in the New Zealand Gazette of 1 March 1990 and 3 November 1993 published in the New Zealand Gazette of 11 November 1993.

Pursuant to section 14 (8) of the Dumping and Countervailing Duties Act 1988, I have also initiated a review of the need for the continued imposition of anti-dumping duty on the goods described in the Schedule to this notice, imported from Belgium, Denmark and the Netherlands. Anti-dumping duty was imposed on these goods by the Minister of Commerce by notice dated 7 June 1989 published in the New Zealand Gazette of 15 June 1989 and reassessed in notices dated 30 January 1990 published in the New Zealand Gazette of 8 February 1990 and 3 November 1993 published in the New Zealand Gazette of 11 November 1993.

Description of Goods

Refined sugar, being refined white sugar and other types of refined sugar (refined from sugar cane or from sugar beets).

The goods in the Schedule are currently classified under the following Tariff Items and Statistical Keys of the Tariff of New Zealand.

1701.11.00 (Statistical Keys 01F to 09A), 1701.12.00 (Statistical Keys 01L to 09F), 1701.91.00 (Statistical Keys 01E to 19H), 1701.99.00 (Statistical Keys 01A to 49F)

These Tariff items and statistical keys are provided for convenience and Custom purposes only, the written description being dispositive.

Note:

This note is not part of the notice but is intended to indicate its general effect.

Anti-dumping duties on refined sugar (sugar refined from sugar cane or sugar beet) from Malaysia, which are currently applicable will cease to be payable as from 3 November 1998 in terms of section 14 (9) of the Dumping and Countervailing Duties Act 1988.

The current anti-dumping duties on refined sugar (refined from sugar cane or sugar beet) imported into New Zealand from the countries specified in this notice will remain in force at least until the outcome of this review is known.
