Charitable Trusts Act Notices

Application for Order to Vary a Charitable Trust

Take notice that the Presbyterian Church trustees have applied to the High Court at Wellington for an order for variation of deed of trust dated the 10th day of December 1952 of Alice Mary MacFarlane.

The proposed scheme of variation provides that in respect of the property at 31 Castor Bay Road, Castor Bay (legally described as being Lot 16, Deposited Plan 11904, being portion of Allotment 190, Parish of Takapuna, C.T. 369/290 (North Auckland Registry)) the trustees will use the:

(a) Property;

(b) Proceeds from any sale of the property;

(c) Proceeds from any lease of the property;

for residential purposes in connection with the work of the Presbyterian Church of New Zealand; such as:

(a) A manse or manses;

(b) Orphanage or orphanages;

(c) A rest home or homes of a suitable nature.

The date of hearing of the application is the 5th day of October 1998 at 10.00 a.m.

Any person desiring to oppose the application must give written notice of their intention to do so to the Registrar of the High Court at Wellington, the applicants and the Attorney-General not less than 7 clear days before the date of hearing.

Napier Community Trust Hospital

Notice of Application for Order to Vary a Charitable Trust

Take notice that on the 27th day of October 1998 at 9.30 a.m., the trustees of the Napier Community Trust Hospital will apply to the High Court at Napier for an order:

1. Varying the mode of administering the trust

2. Varying the powers of the trustees

as set out in the declaration of the trust dated on the 10th day of February 1998.

The application, declaration of trust and Attorney-General’s report are open for inspection by the public at the office of the High Court at Napier.
