Advertisement of Application to Vary Terms of a Trust Fund

In the matter of the Charitable Trusts Act 1957 and in the matter of an application by the Pukeiti Trust Fund—Applicant:

And—Pukeiti Rhododendron Trust—Interested Party:

Take notice that the trustees of the Pukeiti Trust Fund will apply to the High Court New Plymouth on Thursday, the 10th day of September 1998 at 9.30 a.m. for an order varying the terms of the Pukeiti Trust Fund deed dated the 29th day of October 1971.

Further particulars may be obtained from the office of the applicant’s solicitors. The purposes of this application is to vary the investment powers of the trustees and to make other minor alterations to the trust deed.

Any person desiring to oppose the scheme is required to give notice in writing of his/her intention to do so to the Registrar of the High Court at New Plymouth, the trustees of the applicant care of Govett Quilliam, the Lawyers, Private Bag 2013, New Plymouth (Attention: S. W. Hughes) and the Attorney-General, care of the Crown Law Office, P.O. Box 5012, Wellington (Attention: M. A. Soper), not less than 7 days before the matter is due to be heard.

Deckton Hebrew Trust

Notice of Application for Approval of a Scheme

Under Part III of the Charitable Trusts Act 1957

Notice is hereby given that the trustees of the Deckton Hebrew Trust established by deed of trust dated on the 31st day of March 1936, and amended by the Deckton Hebrew Trust Act 1936, have filed in the office of the High Court at Wellington, an application for approval of a scheme varying the terms of the trust deed.

Under the scheme the terms of the trust deed will be widened so that the trust fund will be held on trust for the benefit of the following:

Any Jewish orphanage or institution in the nature thereof in New Zealand;

Any Jewish institution for the care of the aged and infirm in New Zealand;

Any Jewish organisation providing care and support for the aged and infirm in New Zealand whether or not resident in a Jewish institution;

The Wellington Hebrew Philanthropic Society;

Any Jewish day school providing secular and orthodox Jewish religious education in New Zealand;

The Wellington Branch of the Friends of the Hebrew University (Jerusalem); and

Any Jewish organisation providing orthodox Jewish religious services, education, culture or youth activities or the amenities and facilities within which such activities may be carried on in New Zealand.

Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Wellington or at the office of Johnston Lawrence, solicitors for the trustees, Level Six, Wool House, corner of Brandon and Featherston Streets, Wellington.

The application has been set down for hearing in the High Court at Wellington on the 7th day of September 1998.

Any person desiring to oppose the scheme is required to give notice of his or her intention to do so to the Registrar of High Court at Wellington and Johnston Lawrence, solicitors for the trustees, Level Six, Wool House, corner of Brandon and Featherston Streets, Wellington, and the Attorney-General not less than 7 clear days before the above-mentioned date.
