Land at 135 Mount Pleasant Road Acquired for Local Purpose Drainage Reserve Together With a Right of Way Easement

Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired (subject to a right to drain water granted by transfer 502899/1 and rights of way easements granted by transfer 670047 and reserved by transfer 688792 together with a right of way easement granted by transfer 688792) for local purpose drainage reserve, subject to the Reserves Act 1977, together with a right of way easement described in the Second Schedule hereto, over the land described in the Third Schedule hereto, to be held forever appurtenant to the land described in the First Schedule hereto, and shall vest in The Christchurch City Council on the date of publication of this declaration in the New Zealand Gazette.

First Schedule

Canterbury Land District—Christchurch City

4611 square metres (1 acre 0 rood 22.3 perches), being part Lot 1 on Deposited Plan 17670, part certificate of title 6A/1277.

Second Schedule

Description of Right of Way Easement

The full, free, uninterrupted, and unrestricted right, liberty, and privilege for the grantee, his servants, tenants, agents, workmen, licensees, and invitees (in common with the grantor, his tenants, and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go, pass and repass with light machinery and implements of any kind over and along the land over which the right of way is granted or created.

Third Schedule

Amending Notice—Land at Earl Road, Temuka Acquired for River Protection Purposes and Severance

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, hereby amends the notice with the above heading dated the 28th day of November 1997 and published in the New Zealand Gazette on the 11th day of December 1997, No. 173 at page 4142, by substituting:

(a) the letter "Z" for the letter "A" in the First Schedule.

(b) the letter "E" for the letter "B" in the Second Schedule.

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Manager, Crown Property Services, Land Information New Zealand, Dunedin:

(a) Pursuant to section 114 of the Public Works Act 1981, that the land described in the First Schedule hereto, be declared road and shall vest in The Southland District Council.

(b) Pursuant to sections 116 and 117 of the Public Works Act 1981, that the road described in the Second Schedule hereto, be stopped.
