Fisheries (Quota Aggregation Limit Exemption) Notice (No. 5) 1997 (No. F62)

Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission, and after having regard to the provisions of section 28W (5) of the Fisheries Act 1983, hereby gives the following notice:

NOTICE

  1. Title and commencement—
    (a) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 5) 1997.
    (b) This notice shall come into effect on the day after its notification in the New Zealand Gazette.

  2. Interpretation— In this notice, “Southern Scallop Fishery” has the meaning ascribed to it in section 2 of the Fisheries Act 1983.

  3. Exemption to quota aggregation limit—
    (a) As from the date that this notice comes into effect, the Challenger Scallop Enhancement Company Limited is permitted to hold quota and interest in quota in excess of the 20 percent aggregation limit for the Southern Scallop Fishery as provided in section 28W (1) of the Fisheries Act 1983, up to an aggregation limit of 100 percent.

    (b) As from the date that this notice comes into effect, the Directors of the Challenger Scallop Enhancement Company Limited are permitted to hold quota and interest in quota in excess of the 20 percent aggregation limit for the Southern Scallop Fishery as provided in section 28W (1) of the Fisheries Act 1983, up to a limit of 100 percent.
