Advertisement of Application for Order Under Section 209ZG of the Companies Act 1955

Take notice that on the 29th day of November 1996, an application for an order under section 209ZG of the Companies Act 1955 in respect of Carmel Properties Limited was filed in the High Court at Invercargill.

The orders sought are orders:

(a) Directing rectification of the records of the defendant company by removing all reference to the purported increase of capital of 90 000 $1 shares.

(b) Requiring the defendants to acquire the applicants’ shares in the defendant company.

(c) That compensation be paid to the applicants.

The application is to be heard before the High Court at Invercargill on the 17th day of February 1997 at 10.00 a.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.

The applicants are Martin Walter Lawn and Robert Francis Lawrence as executors in the estate of John Patrick Lawn, late of Queenstown, real estate agent, deceased, whose address for service is at the offices of Hall Coton Lawrence, Solicitors, PSA House, 333 Princes Street, Dunedin.
