Patents Act 1953

Appointment of Place to be the Patent Office

Pursuant to subsection 1 of section 5 of the Patents Act 1953, the Minister of Commerce hereby declares that as from the 1st day of August 1997, the following places are appointed to be the “Patent Office” under and for the purposes of the said Act:

  • those rooms occupied and known as the “Intellectual Property Office of New Zealand” in Levin House, High Street, Lower Hutt; and

  • those rooms occupied by and known as the “Intellectual Property Office of New Zealand - Hearings Office” on Level One, NGC House, 22 The Terrace, Wellington; and

  • those rooms occupied by and known as the “Document and Information Service Centre” of the Ministry of Commerce at 17 Toop Street in Seaview, Lower Hutt.

The business centre at Levin House will be responsible for all patent, trade mark and design examinations and related activity including technical advice and client services. It will operate from Levels Three, Four and Five of Levin House.

The Hearings Office will focus on the ex parte and quasi-judicial aspects of the Patent Office’s role. This includes hearings in relation to oppositions, revocation, extensions of term and amendments for specification.

The Document and Information Service Centre will be responsible for the processing of applications for patents, trade marks and designs and document management functions for the Patent Office. The Service Centre will also provide a document management facility for other business units of the Ministry of Commerce.

Plant Variety Rights Act 1987

Appointment of Place and Hours of Plant Variety Rights Office

Pursuant to section 28 of the Plant Variety Rights Act 1987, I hereby appoint the place of the Plant Variety Rights Office to be at the Canterbury Agriculture and Science Centre, Gerald Street, Lincoln, Canterbury and fix the hours during which the office shall be open for the transaction of public business under the Plant Variety Rights Act 1987, as being from Monday to Friday, inclusive during the hours between 8.30 a.m. to noon and 12.30 p.m. to 4.30 p.m. other than any day which is a public holiday in terms of section 7A (2) of the Holidays Act 1981, or any day during the period in every year from 27 December to 31 December inclusive.

The notice dated 6 August 1979, and which was published in the New Zealand Gazette on 6 September 1979, given by the Minister of Agriculture under the Plant Varieties Act 1973, which appointed the place and hours of business of the Plant Varieties Office is hereby revoked.

Explanatory Note:

This notice is not part of the notice but is intended to indicate its general effect.

This notice, which comes into force on its date of publication in the New Zealand Gazette, appoints a place to be the Plant Variety Rights Office and fixes the hours during which it shall be open for business.

This notice also revokes the previous notice, given by the Minister of Agriculture under the Plant Varieties Act 1973, which appointed the place and hours of business of the Plant Varieties Office. Section 39 (1) of the Plant Variety Rights Act 1987, despite the repeal of the Plant Varieties Act 1973, deemed the place appointed by that notice to be the place of the Plant Variety Rights Office.

Criminal Justice Act 1985

Order for Confiscation of Motor Vehicle

Pursuant to Section 84 (2) of the Criminal Justice Act 1985

On the 11th day of July 1997 at the District Court at Hamilton, Zak Bertram Upton of 46A Abbotsford Street, Hamilton, was convicted and fined $200.00 and $95.00 Court costs following his conviction on a charge of driving while disqualified.

And in addition to the above-mentioned penalty, Judge A. N. MacLean has ordered that a

owned by the above-mentioned defendant, Zak Bertram Upton, be forfeited to Her Majesty the Queen, pursuant to section 84 (2) of the Criminal Justice Act 1985.
