Declaring Leasehold Estate Acquired for Police and Public Safety Communications Purposes at Roys Peak in the Queenstown-Lakes District
Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager Crown Property Services, Land Information New Zealand, Dunedin, declares the leasehold estate described in the Schedule hereto, to be acquired for police and public safety communication purposes and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Amending Notice
Road Deviation at Weka Pass
Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, hereby amends the notice with the above heading dated the 27th day of May 1997 and published in the New Zealand Gazette, on the 5th day of June 1997, No. 56 at page 1326, by substituting “5400” for “5340” in the Second Schedule.

Pursuant to sections 20 and 28 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for soil conservation and river control purposes and shall vest in The Waikato Regional Council on the date of publication hereof in the New Zealand Gazette, subject to the right of way easement described in the Second Schedule hereto, over the land described in the Third Schedule hereto, to be held appurtenant to the land described in the Fourth Schedule hereto.

Second Schedule
South Auckland Land District
Description of Easement
The rights and powers implied by and attaching to a right of way as set out in the Seventh Schedule of the Land Transfer Act 1952 under the heading “Right of Way” as if the same were fully set out herein, provided that:
(a) The Waikato Regional Council (being a regional council constituted by the Local Government (Waikato Region) Reorganisation Order 1989 in New Zealand Gazette, 1989, No. 99, page 2463) (called the “council”) will maintain and keep in good repair the said easement to a standard sufficient in the opinion of the council to enable the registered proprietor of the land in the Fourth Schedule (called “the owner”) to satisfactorily carry out his normal farming business. Provided that such maintenance and repair is not attributable to the neglect or default of the owner, his servants or invitees.
(b) That the owner will give the council prompt notice in writing of any defect or want of repair to the said easement and that the council shall not be liable for any deterioration or damage unless in receipt of such notice and the council shall within reasonable time thereafter to its satisfaction remedy such defect.
(c) That the council and owner agree that should the said easement become unusable then they shall be relocated as agreed.
