Land at Rangiora Acquired for Conservation Purposes (Fire Station)

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for conservation purposes (fire station) together with an easement to convey water described in the Second Schedule over the land described in the Fifth Schedule and to convey electricity described in the Third Schedule over the land described in the Sixth Schedule to be forever appurtenant to the land described in the Fourth Schedule and to convey water described in the Seventh Schedule over the land described in the Eighth Schedule, and shall vest in the Crown on the date of publication of this declaration in the New Zealand Gazette.

Second Schedule

Canterbury Land District—Waimakariri District

The full right of the Crown to convey water within the meaning and provisions of the Seventh Schedule of the Land Transfer Act 1952.

Third Schedule

Canterbury Land District—Waimakariri District

All that parcel of land being part Lot 1, D.P. 62909; shown marked “C” on S.O. Plan 19727.

Fourth Schedule

Canterbury Land District—Waimakariri District

The full right to convey water and electricity within the meaning and provisions of the Seventh Schedule of the Land Transfer Act 1952, provided that the rights and powers attaching to the right to convey electricity shall be the same as applies to the right to convey water save that “cables” shall be substituted for “pipes” and “electricity” for “water” wherever the words appear in the Seventh Schedule of the Land Transfer Act 1952.

All that parcel of land the centreline of which is shown marked “D-E-F” on Survey Office Plan 19727.

Sixth Schedule

Declaring Easement Over Land Acquired for Soil Conservation and River Control Purposes in Block XII, Heretaunga Survey District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Team Member, Crown Property Services, Land Information New Zealand, Napier, declares an agreement to that effect having been entered into, the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the New Zealand Gazette) vesting in The Hawke’s Bay Regional Council (called “the grantee”) on the date of publication in the New Zealand Gazette. The right to construct a river stopbank including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Schedule (called “the land”):

(a) to enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) to modify, maintain or reconstruct the stopbank and to do all things necessary to maintain the same in an efficient state;

(c) to prohibit over grazing of the land and destruction or vegetation by fire or cultivation;

(d) to prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) on the land;

(e) to prohibit the erection of any building on the land; and

(f) to exercise the within rights in a manner reasonably necessary to serve the purpose of the work.

All that piece of land situated in Block XII, Heretaunga Survey District, as shown marked “E” and “F” on S.O. Plan 10742, lodged in the office of the Chief Surveyor at Napier.
