Public Works Act 1981

Easement in Gross to Drain Sewage Acquired in Tauranga District

Pursuant to sections 20 and 28 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, an easement in gross to drain sewage as described in the First Schedule hereto, is hereby acquired over the land described in the Second Schedule hereto; and further declares that the said easement shall vest in The Tauranga District Council on the date of publication hereof in the New Zealand Gazette.

First Schedule

Description of Right to Drain Sewage Easement

The rights and powers implied in and attaching to a right to drain sewage easement as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right to Drain Sewage”, together with the additional rights contained in paragraph 5 of the said Seventh Schedule, as if the same were fully set out herein.

Amending a Notice Declaring Land Set Apart for Better Utilisation in Hauraki District

Pursuant to section 55 of the Public Works Act 1981, the Minister of Lands hereby amends the notice dated the 26th day of June 1997, and published in the New Zealand Gazette of 17 July 1997, No. 73, at page 1786, declaring land set apart for better utilisation in Hauraki District, by amending the area from “356 hectares” to “356 square metres”.

Road Realignment—State Highway No. 5, Earthquake Flat Rotorua District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Lands:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road which, pursuant to section 50 (2) of the Transit New Zealand Act 1989, forms part of State Highway No. 5 which shall vest in the Crown.

(b) Pursuant to section 119, the land described in the Second Schedule to be taken, and further declares:

(i) The area marked “J”, now known as Section 1, S.O. 60714, shall be amalgamated with the land in certificate of title 56C/234.

(ii) The areas marked “M”, “N” and “O”, now known as Sections 4, 5 and 6, S.O. 60714 respectively, shall be amalgamated with the land in certificate of title 22A/1371, subject to mortgage H. 758053.1 and H. 419490.3.

(c) Pursuant to sections 116 and 117, the portion of road described in the Second Schedule to be stopped, and further declares:

(i) The area marked “K”, now known as Section 2, S.O. 60714, shall be amalgamated with the land in certificate of title 56C/234.

(ii) The areas marked “L” and “P”, now known as Sections 3 and 7, S.O. 60714, respectively, shall be amalgamated with the land in certificate of title 22A/1371, subject to mortgage H. 758053.1 and H. 419490.3.
