Civil Aviation Act 1990

Notice of Granting of an Open Aviation Market Licence and Variation of a Scheduled International Air Service Licence

Pursuant to sections 87U(4) and 87Q(4) of the Civil Aviation Act 1990, and a delegation from the Secretary for Transport, dated 28 August 1996, I give notice that, having received an application from United Air Lines, Inc., of Chicago, United States of America, I have:

(a) granted that airline an open aviation market licence to carry on scheduled services and non-scheduled flights in accordance with the 18 June 1997 Air Transport Agreement Between the Government of New Zealand and the Government of the United States of America, for an indefinite term with effect from 1 December 1997; and

(b) varied the scheduled international air service licence granted to the airline to provide for that licence to expire on 30 November 1997.

ORDER IN COUNCIL

At Wellington this 17th day of November 1997

The Hon. JENNY SHIPLEY presiding in Council

Pursuant to section 28 of the State-Owned Enterprises Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, makes the following order.

Order

  1. Title—This order may be cited as the State-Owned Enterprises (Mangahao Power Station Limited Vesting Order No. 1) Order 1997.

  2. Interpretation—(1) In this order,—

“The Dams and Structures” means all dams and structures (whether on or adjacent to the operating easement land, or situated elsewhere) in respect of which the Grantee is for the time being entitled to exercise the Grantee’s rights under the easement vested by clause 3:

“Enactment” includes bylaw:

“Grantee”, in relation to any easement vested by this order,—

(a) Means the holder for the time being of the easement (whether by vesting under this order, by assignment, by operation of law, by succession, or otherwise howsoever); and

(b) Includes the Grantee’s agents, consultants, contractors, employees, engineers, invitees, licensees, servants, subsidiaries, surveyors, tenants, and workers:

“Grantee’s rights” means the interests, liberties, powers, and rights conferred on the Grantee by this order; and “Grantee’s right” has a corresponding meaning:

“Grantor”, in relation to any part of the Servient Land,—

(a) Means the owner of that part; but

(b) For so long as Her Majesty the Queen in right of New Zealand is the owner of that part, means Her Majesty acting through the Director-General of Conservation:

“Operating Easement Land” means the land described in Schedule 2:

“Permission” includes agreement, authority, consent, direction, licence, permit, and right:

“Right of Way” means the easement vested by clause 5:

“Right of Way Land” means the operating easement land and the land described in Schedule 6:

“Servient Land” means the land described in Schedules 2, 4, 6, and 8:

“Transmission Line”—

(a) Means conductor, coaxial cable, fibre-optic cable, or wire, used for the transmission of electricity, telecommunications impulses, signals, or waves, or both; and

(b) In relation to any Transmission Line, includes—

(i) Any alarm, casing, cross-arm, fixture, foundation, ground-stay, insulator, pole, supporting structure, tower, tube, tunnel, or other equipment or material used to enclose, secure, protect, support, or surround the line, or to protect people from harm caused by the line or its operation; and

(ii) Any capacitor, circuit-breaker, fuse, fuse-holder, tower-mounted transformer, meter, pole-mounted transformer, switch, voltage regulator, or other device or instrument used in association with the
