Declaring Railway Land to be Set Apart for Local Purpose Reserve (Historic) and Road and a Right of Way Easement Acquired for Railway Purposes in the Waitaki District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Crown Property Services, Land Information New Zealand, Dunedin, declares that, an agreement to that effect having been entered into:

(a) Pursuant to sections 20 and 50, the land described in the First Schedule hereto, to be set apart for local purpose reserve (historic) and the land in the Second Schedule to be set apart for road, and for all of the land to vest in The Waitaki District Council on the 18th day of September 1997.

(b) Pursuant to sections 20 (1) and 28, a right of way easement in gross over the land described fourthly in the First Schedule hereto, vesting in the Crown the rights and powers contained in paragraph 1 of the Seventh Schedule to the Land Transfer Act 1952, is hereby acquired for railway purposes and shall vest in the Crown on the 18th day of September 1997.

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired, subject to a right to convey water and together with rights to convey water and electricity and to convey water as specified in Gazette notice A301092.1, for justice purposes and shall vest in the Crown on the date of publication of this declaration in the New Zealand Gazette.

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, hereby amends the notice with the above heading, dated the 27th day of May 1996, and published in the New Zealand Gazette on the 13th day of June 1996, No. 61 at page 1538, by substituting in the First Schedule, on the line beginning telecommunication purposes, marked “C” with marked “D”.

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Land Information New Zealand, Christchurch, hereby amends the notice with the above heading, dated the 22nd day of August 1997, and published in the New Zealand Gazette on the 28th day of August 1997, No. 108, at page 2550, by substituting the word “road” in the declaration thereto with the words “road diversion”.
