Notice

(1) This notice may be cited as the Traffic (Tauranga District) Notice 1996.

(2) Those localities and roads shown within markings identified in the legend of and appearing on the plan numbered TT9624/1, entitled “Tauranga District Roading Speed Restrictions” and held by the head office of the Land Transport Safety Authority, are declared to be closely populated localities at all times, pursuant to section 52 (1) of the Transport Act 1962, 70 kilometre an hour speed limit areas, pursuant to regulation 21 (2) of the Traffic Regulations 1976, or are excluded from the limitation as to speed imposed by section 52 (1) of the Transport Act 1962, pursuant to section 52 (2) of the Transport Act 1962 and regulation 21 (2) of the Traffic Regulations 1976, as may be ascertained from the legend. The plan and legend are hereby incorporated into this notice.

(3) This notice revokes and is in substitution for all previous traffic notices issued, pursuant to section 52 of the Transport Act 1962 and regulation 21 (2) of the Traffic Regulations 1976, for the former Tauranga City, Tauranga County, Tauranga District and Mount Maunganui Borough now comprising the Tauranga District.

Transport (Vehicle Standards) Regulations 1990

Exemption From Specified Requirements of the Transport (Vehicle Standards) Regulations 1990

Pursuant to regulation 36 of the Transport (Vehicle Standards) Regulations 1990, I, Peter Nicholas Rendall, Senior Vehicle Compliance Officer, hereby exempt the motor vehicle specified in Schedule 1 of this notice from the requirements contained within regulations 29 (1) (a), (3) and (4) of the Transport (Vehicle Standards) Regulations 1990, subject to the conditions specified within Schedule 2 of this notice.

Securities Act 1978

Notice of Approval of Act as a Statutory Supervisor Under Section 48 of the Securities Act 1978

Pursuant to section 48 of the Securities Act 1978, the Securities Commission hereby approves Covenant Trustee Company to act as statutory supervisor, for the purposes of the Securities Act 1978, in respect of participatory securities to be offered to the public for subscription for a period of 5 years from the date of this notice. The approval is given subject to the following conditions:

(a) That Covenant Trustee Company is not at any time a member of an issuer in respect of which it acts as statutory supervisor;

(b) That Covenant Trustee Company does not at any time hold any office or appointment (including appointment as auditor) in respect of the issuer or any manager of the scheme in respect of which it acts as statutory supervisor;

(c) That Covenant Trustee Company does not at any time control or does not have the right to control, directly or indirectly, the issuer or any manager of the scheme, in respect of which it acts as statutory supervisor otherwise than in connection with the performance of its functions and powers;

(d) That Covenant Trustee Company does not at any time hold any participatory securities issued by the issuer or any manager of the scheme;

(e) That no relationship exists at any time between Covenant Trustee Company and the issuer, or any manager of the scheme, in respect of which it acts as statutory supervisor that affects, or is likely to affect, the ability of the company to perform its functions and powers as statutory supervisor;

(f) That while Covenant Trustee Company holds office as statutory supervisor satisfactory professional indemnity insurance is maintained in respect of the exercise of its functions and powers as statutory supervisor.

The approval of Covenant Trustee Company to act as statutory supervisor dated 8 September 1988, is hereby revoked.
