TARIFF CONCESSION SHORTFALL POLICY
The Ministry of Commerce has recently completed a review of the policy provisions which exist for Part II tariff concessions to be considered under reference 99 for goods in shortfall.
As a result of the review, the provisions for concession approval have been split between shortfalls of “manufacturing inputs” and shortfalls of “other than manufacturing inputs”. In the case of the former, approval will be limited to a specific quantity to those manufacturers who normally source their inputs locally and who have suffered as a direct consequence of the shortage. In the case of the latter, concessions will be generally available for use by all traders during the period of proven shortfall.
The revised policy is as follows:
(a) Shortfalls of Manufacturing Inputs
Applications from manufacturers’ for shortfall concessions will be considered if an input into the manufacturing process is not able to be supplied in normal quantities due to an unforeseen and unusual particular identifiable event and they are unable to obtain alternative supplies from within New Zealand. All applications will require the support from the traditional suppliers – grower/processor/manufacturer (if they themselves are not the applicant). Concessions issues under this category will be limited to those manufacturers who have suffered as a direct consequence of the shortfall, they will be for an agreed period of time, and be restricted to the quantity which is in shortage.
(b) Shortfalls of other than Manufacturing Inputs
Applications for shortfall concessions will be considered under this category where there is a shortage of other than manufacturing inputs as a result of an unforeseen and unusual particular identifiable event. All applications will require support from the traditional suppliers to verify the shortfall – grower/processor/manufacturer (if they themselves are not the applicant). Concessions issued under this category will be published in the New Zealand Gazette, Customs Edition as being generally available, and issued for limited periods of time.
Manufacturers may not always be in a position to apply directly. Therefore applications can be lodged on a manufacturer’s behalf by an agent/importer/distributor.
