Health and Safety in Employment Act 1992

Notice of Intention to Apply for Ministerial Approval of a Code of Practice Under the Health and Safety in Employment Act 1992—Management of Noise in the Workplace

Pursuant to section 20 of the Health and Safety in Employment Act 1992, I, Robert J. M. Hill, General Manager, Occupational Safety and Health Service of the Department of Labour, in exercise of those powers delegated to me by the Secretary of Labour, pursuant to section 41 of the State Sector Act 1988, hereby give notice of intention to apply to the Minister of Labour for his approval of a statement of preferred work practices or arrangements for health and safety in the management of noise in places of work under the Health and Safety in Employment Act 1992.

These preferred work practices or arrangements are designed to describe the general health and safety provisions for the management of excessive noise in places of work and for the protection of employees and others from excessive noise exposure.

Directions to Licensed Casino Operators—Internal Controls, and Administrative and Accounting Procedures

Pursuant to section 70 (1) of the Casino Control Act 1990, the Casino Control Authority hereby gives to:

(1) Aspinall (NZ) Limited, and

(2) Harrah’s New Zealand Inc.

directions as set out in the Schedule to this notice.

(1) These directions shall come into force on 31 May 1996.

(2) The Authority may add to, substitute for, cancel, or vary all or any of the provisions of these directions pursuant to the provisions of section 70 of the Act.

  1. Application

These directions apply to and in relation to the operation of:

(a) the casino at 30–38 Victoria Street, Christchurch by Aspinall (NZ) Limited; and

(b) the casino at the property bounded by Hobson Street, Wellesley Street West, Federal Street and Victoria Street West, Auckland by Harrahs New Zealand Inc.

  1. Construction

(1) Nothing contained in these directions shall be so construed as to conflict with any provision of the Act or of any other applicable Act.

(2) If any provision of these directions is inconsistent with a provision of the Act or of any other applicable Act:

(a) the provision of the Act or other Act (as the case may be) prevails; and

(b) the application of these directions in relation to the casino licensee and the casino is modified accordingly.

(3) If any provision of these directions, or the application thereof to any person or circumstance, is held to be invalid, that holding shall not be construed so as to affect, impair, or invalidate any of the other provisions of these directions, or the application of the provision held to be invalid to any other person or circumstances, but shall be confined in its operation to the provision directly involved in the holding of the circumstances involved therein.

(4) In these directions, power given to do any act or thing, or submit to any act or thing, is capable of being exercised from time to time, as the occasion may require, unless the contrary intention appears.
