Amending a Notice Declaring Land Acquired for Road, Road Stopped and Land Taken in the City of Dunedin

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager (Lands and Property), Department of Survey and Land Information, Dunedin, hereby amends the notice dated the 2nd day of April 1996 and published in the New Zealand Gazette, 4 April 1996, No. 33 at page 984, declaring land acquired for road, road stopped and land taken in the city of Dunedin by omitting from the area thirdly described in the Fifth Schedule reference to “shown ‘B’ on S.O. Plan 19070” and replacing it with “shown ‘A’ on S.O. Plan 24223”.

State-Owned Enterprises Act 1986

Land Vested in Landcorp Investments Limited

Pursuant to section 24 (1) of the State-Owned Enterprises Act 1986, and to an authorisation dated 26 April 1995 from the Ministers of Finance and State-Owned Enterprises, the National Regulatory Manager, Department of Survey and Land Information, hereby gives notice as follows:

Notice

  1. Title—This notice may be cited as the Landcorp Investments Limited Vesting Notice 1996 No. 7.

  2. Application—(1) This notice applies to all the land described in the Schedule to this notice, saving and excepting:

(a) The bed of any lake whose bed has an area of 8 hectares or more.

(b) The bed of any river whose bed has an average width of 3 metres or more.

(c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.

(2) In subclause (1) of this clause, the terms “bed”, “lake”, and “river” have the meanings assigned to them by section 2 (1) of the Resource Management Act 1991.

  1. Vesting—Subject to section 24 of the Conservation Act 1987, the land to which this notice applies shall vest for an estate in fee simple in Landcorp Investments Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington and being a State enterprise within the meaning of section 29 (1) of the State-Owned Enterprises Act 1986) on the 23rd day of May 1996.

(i) Together with the appurtenant rights (if any) described in the Schedule to this notice, but,

(ii) Subject to the rights, interests and encumbrances, (if any) to which it is described in the Schedule to this notice as being subject.

Area Description
7.3430 ha Sections 1, 2 and 3, S.O. Plan 19523, situated in Block III, Culverden and Blocks XV and XVI, Lyndon Survey Districts.
3.2383 ha Section 1, S.O. Plan 19580, situated in Blocks II and III, Ashburton Survey District.
