Transport Act 1962

The Transport (Segregation of Infectious Substances in Goods Service Vehicles and Small Passenger Service Vehicles) Conditional Exemption Notice No. 1 1996

Pursuant to section 70F (1A) of the Transport Act 1962, the Director of Land Transport Safety hereby gives the following notice.

Notice

1. Title and commencement—(1) This notice may be cited as The Transport (Segregation of Infectious Substances in Goods Service Vehicles and Small Passenger Service Vehicles) Conditional Exemption Notice No. 1 1996.

(2) This notice will come into force on the date of its publication in the New Zealand Gazette.

2. Conditional exemption—Operators of goods service vehicles and small passenger service vehicles are exempt from the requirements of section 70F (1) (b) of the Transport Act 1962, in respect of those goods specified in the First Schedule to this notice, subject to the conditions set out in the Second Schedule to this notice.

First Schedule

Goods subject to this notice—This notice applies to diagnostic specimens that are infectious substances as defined in section 3.2.6.1 (b) of New Zealand Standard Code of Practice for the Transport of Hazardous Substances on Land (‘NZS 5433:1988’). These are any human or animal material including, but not limited to, excreta, secreta, blood and its components, tissue and tissue fluids.

Second Schedule

Conditions of exemption—1. The diagnostic specimens must be contained both within inner packaging consisting of a watertight primary receptacle and watertight secondary packaging, and within outer packaging.

2. Both the secondary inner packaging and the outer packaging must:

(a) Meet the Test requirements for packagings specified in section 6.1.4 of the United Nations Recommendations on the Transport of Dangerous Goods, 9th Edition 1995 (these being two tests, one commonly referred to as the drop test and the second being referred to as either the impact resistance test, penetration test or puncture test); and

(b) Where the diagnostic specimens, including the inner and outer packaging, are intended to be stacked, meet the Stacking test specified in section 9.7.6 of the United Nations Recommendations on the Transport of Dangerous Goods, 9th Edition 1995; and

(c) Include sufficient absorbent material in the inner packaging, between the primary receptacles and the secondary packaging, to absorb the entire liquid content of the primary receptacles.

3. The outer packaging must be:

(a) made of metal or plastic; and

(b) labelled in accordance with section 4.2 of NZS 5433:1988; and

(c) marked in accordance with paragraphs (a), (e), (f) and (g) of section 5.5.4 of NZS 5433:1988; and

(d) marked with the text “CLASS 6.2”.

4. Where more than one primary receptacle is placed in secondary inner packaging, the receptacles must be individually wrapped so as to prevent damage resulting from contact between those receptacles.

5. All packaged diagnostic specimens must be restrained in the vehicle to meet the requirements of section 1, chapter 3, of the Truck Loading Code, 1995 edition.

6. The secondary inner packaging and the outer packaging must be tested for compliance with condition 2 of this Schedule by a testing laboratory that is accredited to ISO Guide 25.

7. Where an operator knows or ought to know that any load or part of the load on the vehicle consists of goods specified in the First Schedule to this notice and is being carried under the terms of this exemption, a copy of this New Zealand Gazette notice must be carried, inside the driver’s door of the vehicle in a readily accessible position and shall be kept together with the particulars required to be carried, pursuant to section 70F (1) (c) of the Transport Act 1962.

8. This notice may be revoked at any time by the Director of Land Transport Safety by notice in the New Zealand Gazette.

Explanatory Note

This notice provides a method for medical diagnostic specimens to be transported by road in the same vehicle with food or food containers where a segregation device is used that meets the specifications set out in the Second Schedule to this notice. The Public Health Policy and Regulation Division of the Ministry of Health has a list of devices that are currently known to be available, and a list of laboratories in New Zealand that have been accredited to ISO Guide 25.

Transport (Vehicle Standards) Regulations 1990

Exemption From Specified Requirements of the Transport (Vehicle Standards) Regulations 1990

Pursuant to regulation 36 of the Transport (Vehicle Standards) Regulations 1990, I, Peter Nicholas Rendall, Senior Vehicle Compliance Officer, hereby exempt the motor vehicle specified in Schedule 1 of this notice from the requirements contained within regulation 26 (1) of the Transport (Vehicle Standards) Regulations 1990, subject to the conditions specified within Schedule 2 of this notice.
