The Treaty of Waitangi Act 1975
State-Owned Enterprises Act 1986

This notice concerns a property at Luggate Road (State Highway No. 1), Albert Town, Wanaka, and Maori claims under the Treaty of Waitangi Act 1975.

The land at Luggate Road (State Highway No. 1), Albert Town, Wanaka, is described in legal terms as all that parcel of land containing 10.2856 hectares, more or less, being Section 1, S.O. Plan 23389 and Section 1, S.O. Plan 23624, situated in Town of Albert Town and being all of the land comprised and described in certificate of title 14B/900 (Otago Registry), and subject to:

1. section 27B of the State-Owned Enterprises Act 1986;

2. a reservation in favour of the Crown of every mineral existing in its natural condition in the land;

3. Part IVA of the Conservation Act 1987; and

4. mortgage 850530/2.

The land was once owned by the Crown. It was transferred to a State Owned Enterprise under the State-Owned Enterprises Act 1986.

There is a special notice or “memorial” on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owners of the land, HEBBARD HOLDINGS LIMITED, has applied to the Waitangi Tribunal to have this notice removed. The application has been made under section 8D of the Treaty of Waitangi Act 1975.

ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 2ND DAY OF JULY 1996.

Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington.

If no claim about this land is made to the Waitangi Tribunal before the 2nd day of July 1996, then the Tribunal may recommend that the land no longer be liable to be resumed by the Crown and returned to Maori ownership under section 27B of the State-Owned Enterprises Act 1986.

Notice of Result of Poll on Loan Proposal—Waimakariri District Council Oxford Sewer Loan 1996

Pursuant to section 38 of the Local Authorities Loans Act 1956, notice is hereby given that a poll of ratepayers taken between 12 March 1996 and 27 March 1996, on the proposal of the above-named local authority to raise a loan of $3,100,000 to be known as the Oxford Sewer Loan 1996, for the purpose of constructing the Oxford Sewer Reticulation Treatment and Disposal System to service the area which has been defined as the Oxford Sewer District, resulted as follows:

The number of votes recorded for the proposal was ... 245

The number of votes recorded against the proposal was ... 157

The number of informal votes was ... 29

I therefore declare that the proposal was carried.
