Land Acquired for an Access Way and a Service Lane—Emerson Street, Napier District

Pursuant to section 114 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Napier, declares an agreement to that effect having been entered into, the land described in the First Schedule is acquired for an access way and the land described in the Second Schedule is acquired for a service lane and shall vest in The Napier City Council on the date of publication in the New Zealand Gazette.

Land Acquired for Road and Road Stopped and Vested—State Highway No. 35, Whangaparaoa-Opotiki District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Napier:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to be road, which, pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of State Highway No. 35.

(b) Pursuant to sections 116 (1) and 117 (3), the road described in the Second Schedule to be stopped, and amalgamated in certificate of title 2D/523.

Land Acquired for Road and Road Stopped—Iona Road, Havelock North

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Napier:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to be road which shall vest in The Hasting District Council.

(b) Pursuant to sections 116 (1) and 117 (3), declares the road described in the Second Schedule to be stopped, and further declares:

(i) The area marked “C” (now known as Section 1, S.O. 10548), shall be amalgamated with the land in certificate of title J1/1319 subject to mortgages 340391.3 and 510203.2.

(ii) The area marked “D” (now known as Section 2, S.O. 10548), shall be amalgamated with the land in certificate of title J1/1318 subject to mortgages 475105.3 and 535378.1.
