Dumping and Countervailing Duties Act 1988

Initiation of Subsidy Investigation: Baked Beans in Tomato Sauce From Italy

Notice is hereby given that, acting pursuant to section 10(1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, I have initiated an investigation to determine both the existence and effect of the alleged subsidisation of the goods described and from the country of origin specified in the Schedule to this notice, being satisfied that sufficient evidence has been provided that—

(a) The goods imported or intended to be imported into New Zealand are being subsidised; and

(b) By reason thereof material injury to an industry has been or is being caused or is threatened.

and also being satisfied that the collective output of those New Zealand producers who have, in writing, expressed support for the application constitutes—

(a) Twenty-five percent or more of the total New Zealand production of like goods produced for domestic consumption (assessed during the most recent representative period, being not less than 6 months); and

(b) More than 50 percent of the total production of like goods produced for domestic consumption (as so assessed) by those New Zealand producers who have, in writing, expressed support for or opposition to the application.

Baked beans in tomato sauce in retail sized cans.

The goods are currently classified under Tariff Item and Statistical Key 2005.51.00 01 of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Invitation for Submissions

A copy of the non-confidential version of the Initiation Report, which contains details of the consideration of the application for an investigation, is available from the Manager, Trade Remedies Group, Ministry of Commerce, P.O. Box 1473, Wellington. Interested parties are invited to make submissions to the Trade Remedies Group on the alleged subsidisation and injury.


Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 4 (Duty Reassessment)

Pursuant to section 14 of the Dumping and Countervailing Duties Act 1988 (“the Act”) as in force immediately before the commencement of the Dumping and Countervailing Duties Amendment Act 1994, in accordance with section 21 of the Dumping and Countervailing Duties Amendment Act 1994, the Minister of Commerce, having carried out a review and reassessment of anti-dumping duty in respect of imports into New Zealand of certain plasterboard from Thailand and having determined a new anti-dumping duty applicable to those goods, gives the following notice.

  1. Title and Commencement—(1) This notice may be cited as the Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 4, and shall be read together with and deemed part of the notice entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand” dated 21 December 1989 and published on page 4 of the New Zealand Gazette of 11 January 1990 (hereinafter referred to as the principal notice).

(2) The reassessed anti-dumping duty, set out in the Schedule to this notice, shall apply to imports of the goods specified in the said Schedule with effect from the day after the date of its publication in the New Zealand Gazette.

  1. Amendment to anti-dumping duty applicable—The principal notice is hereby amended by omitting the Schedule as substituted by the notice in the New Zealand Gazette of 11 May 1995 entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 3 (Duty Reassessment)”, and substituting the Schedule set out in the Schedule to this notice.

  2. Consequential revocation—The notice entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 3 (Duty Reassessment)”, and published on pages 1143 and 1144 of the New Zealand Gazette of 11 May 1995, is hereby revoked.
