Notice of Result of Poll on Loan Proposal—Banks Peninsula District Council—Lyttelton Sewer Loan 1996

Pursuant to section 38 of the Local Authorities Loans Act 1956, notice is hereby given that a poll of ratepayers taken between 1 November 1996 and 16 November 1996, on the proposal of the above-named local authority to raise a loan of $1,278,207 to be known as the Lyttelton Sewer Loan 1996, for the purpose of financing the building of the Lyttelton sewage treatment plant and associated works, resulted as follows:

The number of votes recorded for the proposal was 103.

The number of votes recorded against the proposal was 618.

The number of informal votes was 4.

The number of invalid votes was 4.

I therefore declare that the proposal was lost.

Notice of Intention to Take Land for Road

To: Richard Keene of Wellington, builder ("the owner").

And to: Any other person wishing to object to the proposal below

And to: The registered encumbrancer of the above property namely William Henry Cook (by right of way under transfer number 29721).

1. Please note The Hutt City Council ("the council") proposes to take under section 23 of the Public Works Act 1981, the interest of the owner as registered proprietor of the land described in the Schedule to this notice ("the land").

2. The land is required for road.

Reasons for Taking Land

3. The council considers it essential to take the owner's interest in the land because it has been used by the public as road for many years. The council has maintained the land as public road in the past. It is in the public interest for the land to be acquired for road to ensure continued public access to the land.

Right to Object

4. The owner's interest in the land has not yet been taken.

5. The owner and any other person have a right to object to the taking of the owner's interest in the land.

6. Any owner or other person wishing to object must send a written objection to the Registrar, Environment Court, Department for Courts, P.O. Box 5027, Wellington, on or before 24 January 1997.
