Rights and Powers
In this declaration “the Crown” includes but is not limited to Her Majesty the Queen and her heirs, successors and assigns acting by and through Transit New Zealand (or any successor body) pursuant to the Transit New Zealand Act 1989 and the Public Works Act 1981. The Crown shall be solely liable for all of the future maintenance of the easement areas and all costs associated with that maintenance or repair. The easement is one in perpetuity, however, if the Crown, at her sole discretion, should decide that all or part of the easement is no longer required, the easement may be fully or partially surrendered either by memorandum of transfer or by declaration published in the New Zealand Gazette, pursuant to section 42 (4) of the Public Works Act 1981.
