Order Prohibiting Bankrupt From Carrying on in Business After Discharge

The following order was made in the High Court at Palmerston North on the 14th day of October 1996:

That pursuant to section 111 of the Insolvency Act 1967, Tony Alan Bishop, a bankrupt of Levin, is prohibited after discharge from doing the following things without leave of the Court:

(a) Entering into or carrying on any business or class of business, either alone or in partnership with any person;

(b) Being engaged in the management or control of any business carried on by or on behalf of, or being in the employ of, any of the following persons, namely the bankrupt’s wife, a lineal ancestor or descendant of the bankrupt, the wife or husband of such an ancestor or descendant, a brother or sister of the bankrupt, the wife of such a brother, a sister of the bankrupt, and the husband of such a sister;

(c) Acting as a director or taking part directly or indirectly in the management of a company or class of company.

The receiver and manager has been appointed in respect of all the company’s undertaking and all its real and personal property and all its assets and effects, whatsoever and wheresoever, both present and future, including its uncalled and unpaid capital.
