Appointment of Customs Places

Pursuant to section 9 of the Customs and Excise Act 1996, the Chief Executive of the New Zealand Customs Service hereby designates the places described in the Schedules hereto to be Customs ports or Customs airports, and such Customs ports and Customs airports shall be known collectively as “Customs places”.

SCHEDULE A

CUSTOMS PORTS

Auckland

All that area generally known as:

(a) Waitemata Harbour, including Lucas Creek and Whau River and which comprises all land, sea and estuary to a distance of 100 metres above mean high water mark.

(b) All that area within the Auckland Harbour and pilotage limits including the Rangitoto Channel and Hauraki Gulf, and which comprises all land, sea and estuary to a distance of 100 metres above high water mark that is enclosed at its northern extremity by Whangaparoa Peninsula, Tititiri Island and Shearer Rock and its eastern extremity by a line drawn between Shearer Rock, Rakino Island, Waiheke Island and a line from Park Point Waiheke Island to Musick Point.

(c) Manukau Harbour, and which comprises all land, sea and estuary to a distance of 100 metres above high water mark.

Bluff

All that area known generally as Bluff Harbour and which comprises all land, sea and estuary to a distance of 100 metres above mean high water mark that is enclosed at its south eastern extremity by a line drawn between the promontories of Stirling Point and Tiwai Point.

Gisborne

That part of the area known generally as Poverty Bay which is enclosed by a line drawn between the mouth of the Waipaoa River and the promontory of Tauaheini Point and all land, sea and estuary to a distance of 100 metres above mean high water mark comprised therein.

Lyttelton

All that area known generally as Lyttelton Harbour and which comprises all land, sea, estuary and harbour works to a distance of 100 metres above the mean high water mark that is enclosed at its eastern extremity by a line drawn between the promontories known as Godley Head and Adderley Head.

Napier

That part of the area known generally as Hawkes Bay which is enclosed by a line drawn due south from Tangoio Bluff to the coastline near Haumoana and all land, sea and estuary to a distance of 100 metres above mean high water mark comprised therein.

Nelson

All that portion of sea and river known generally as Port Nelson which follows the coastline north of Main Wharf including all wharves, slipways and structures and Dixon Basin ending at the Maitai River Bridge, and all that land abutting thereon to a distance of 100 metres from the mean high water mark.

New Plymouth

All that area known generally as Port Taranaki, and which comprises all land, sea, structures and erections to a distance of 100 metres above mean high water mark that are enclosed by a line drawn between the seaward extremities of the main and leeward breakwaters.

Opua

All that area known generally as the Bay of Islands comprising all land, sea and estuary to a distance of 100 metres above mean high water mark that is enclosed by a line drawn from Cape Wiwiki to Cape Brett.

Otago

All that area known generally as Otago Harbour and consisting of the lower harbour, known as Port Chalmers, and the upper harbour known as Dunedin, and which comprises all land, sea and estuary to a distance of 100 metres above mean high water and which is enclosed at its north eastern extremity by a line drawn from Heyward Point to Taiaroa Head.

Picton

All that area known generally as Picton Harbour, including Shakespeare Bay, and which comprises all land, sea and estuary to a distance of 100 metres above mean high water mark that is enclosed by a line drawn due east from Wedge Point to the opposite coastline.

Taharoa

All that area of sea within a 4 (four) kilometre radius from Albatross Point, and all land and estuary to a distance of 100 metres from mean high water mark abutting thereon. This Customs place shall be restricted to the purpose of loading titonomagnetite concentrate in bulk.

Tauranga

All that area of water known as Tauranga Harbour enclosed by a line drawn from Stony Point to the corner of Maxwell’s Road and Harbour Drive, then to the eastern point of the Tauranga Harbour Bridge and all land and estuary abutting thereon to a distance of 100 metres from mean high water mark.

Timaru

All that area of sea generally known as the Port of Timaru enclosed by a line drawn from the eastern breakwater extension to the outer northern mole, and bounded by Unwin Road, Marine Parade, Port Loop Road and Ritchie Street, including all land abutting thereon to a distance of 100 metres above mean high water mark.

Waitangi

All that portion of sea, land and river comprised within a circle with a radius of 2 kilometres from the Post Office, Waitangi, Chatham Island.

Wanganui

All the waters of the Wanganui River, harbour and estuary and all the land abutting thereon to a distance of 100 metres above mean high water mark, enclosed by a line drawn between the seaward extremities of the North Mole and South Mole, and by a line drawn due south from the eastern edge of the intersection of Gilberd Street and Heads Road.

Wellington

All that area known generally as Wellington Harbour, and which comprises all land, sea and estuary to a distance of 100 metres above mean high water mark that is enclosed at its southern extremity by a line drawn between the promontories of Pencarrow and Moa Point.

Whangarei

All that area known generally as Whangarei Harbour, and which comprises all land, sea and estuary to a distance of 100 metres above mean high water mark that is enclosed on its eastern extremity by a line drawn from Bream Head to the north bank of the Ruakaka River.
