Health Act 1956

Exemption of Crown Health Enterprises From Section 92D of the Health Act 1956 in Relation to Autologous Blood Transfusions

Notice

Pursuant to section 92E of the Health Act 1956:

I, Jennifer Mary Shipley, subject to the conditions specified in clause 2 of this notice, hereby exempt Crown health enterprises from the prohibition on charging for blood contained in section 92D of that Act.
The exemption in clause 1 of this notice shall apply only to charges imposed in respect of:

(a) (i) Blood collected by a Crown health enterprise pursuant to a contract approved by the Blood Transfusion Trust;

(ii) Blood collected by a Crown health enterprise from a person for the purpose of transfusing the blood back into that person (‘‘autologous blood transfusion’’), in circumstances where an autologous blood transfusion is not clinically indicated for that person.

(b) The reasonable administrative costs associated with collecting, testing and processing such blood.

This notice shall come into force 1 month after the date of its publication in the New Zealand Gazette.
