In the matter of the Companies Act 1955, and in the matter of an application under section 108 of the Companies Act 1955 by Trust Bank of New Zealand Limited (with which Trust Bank Bay of Plenty Limited amalgamated), a duly incorporated company having its registered office at Wellington, bank—Applicant:

Take notice that on Tuesday, 26 September 1995 at 10.30 a.m., the applicant will move the Court at Auckland for the following orders:

1. That the time within which the applicant may deliver to the Registrar of Companies at Auckland for registration against Nikau Enterprises Limited in the manner required by the Companies Act 1955, a debenture securing all moneys presently or at a later date owing to the applicant by Nikau Enterprises Limited, a duly incorporated company having its registered office at Tauranga, by way of first charge over the assets and undertaking of Nikau Enterprises Limited, which debenture dated 25 July 1994, was granted by Nikau Enterprises Limited to Trust Bank Bay of Plenty Limited, which company amalgamated with the applicant under Part VA of the Companies Act 1955 on 1 April 1995, be extended for a period of twenty-one (21) days from the date of the order, or to a fixed date, and upon such terms and conditions as may seem to the Court just and expedient.

2. That the applicant be registered as the holder of the said debenture.

3. Such other orders as this Court deems just.

Notice of Restoration to the Register of Companies

The Companies Act 1955

Take notice that the Registrar of Companies at Wellington proposes to restore the above-named companies to the Register of Companies.

The Registrar proposes to act, under section 303 (1) (a) of the Companies Act 1955, on the grounds that the companies were still carrying on business at the time they were removed from the Register.

Any person who objects to the restoration of any of these companies to the Register must deliver notice of that objection to the Registrar on or before 20 October 1995.
