Notice of Product Ruling

  1. This is a notice of a product ruling made under section 91F of the Tax Administration Act 1994.

  2. Product ruling No. 95/2 was issued on 11 August 1995. It relates to an employee share purchase scheme for the benefit of employees of United Airlines New Zealand branch.

  3. A copy of the ruling may be obtained by writing to the Manager (Systems), Rulings Directorate, National Office, Inland Revenue, P.O. Box 2198, Wellington.

Gaming and Lotteries Act 1991

Permission to Conduct Within New Zealand a Lottery Conducted Outside New Zealand

Pursuant to section 69 of the Gaming and Lotteries Act 1991, I Warren Cooper, Minister of Internal Affairs, hereby permit Time Inc. Magazine Co. Pty Limited, to conduct within New Zealand, subject to the conditions specified in the Schedule to this notice, a lottery promoted outside New Zealand as a sales promotion scheme to promote the subscriptions for Time Magazine.

The permission given by this notice is subject to the following conditions, namely:

(1) Time Inc. Magazine Co. Pty Limited will not conduct the lottery within New Zealand after 11 September 1996.

(2) The results of the lottery will be published in the Sunday Star Times on 29 September 1996.

(3) New Zealand winners shall not be subject to any disadvantage as a result of winning a prize. All freight, customs, handling and delivery charges and any insurance costs to cover theft or damage to prizes coming from outside New Zealand will be met by Time Inc. Magazine Co. Pty Limited.

(4) A New Zealand participant shall have a chance of winning which is equivalent to that of an overseas participant.

New Zealand Flags, Emblems and Names Protection Act 1981

Visit of The Queen and The Duke of Edinburgh to New Zealand 1995

  1. It is announced, in connection with the visit of The Queen and The Duke of Edinburgh to New Zealand in November 1995, that the rules governing the use of Royal Emblems, which normally are permitted to be reproduced only in the most exceptional circumstances, will be temporarily relaxed to allow them, in accordance with the conditions set out hereunder, to be reproduced on souvenirs and displays commemorating this visit. A similar relaxation is afforded to Royal photographs and portraits.

  2. (a) Souvenirs are defined as articles of a permanent kind specifically designed to commemorate the visit and identified with it by a phrase such as:

“The Royal Visit 1995”

“The Queen’s Visit 1995”

“New Zealand 1995”

(b) Such souvenirs must:

(i) Be in good taste.

(ii) Be free from advertisement.

(iii) Carry no implication of Royal Custom or approval.

(iv) NOT to be used as a premium or selling aid.

  1. The Royal Emblems and portraits mentioned in paragraph 1 are:

(a) *The Royal Arms or component parts thereof (such as the Supporters or the Crown).

(b) *The Arms of The Duke of Edinburgh.

(c) *Formal representations of the Royal Crowns.

(d) Photographs or portraits of The Queen and/or The Duke of Edinburgh.

*May NOT be used on medals.

Note: The New Zealand flag may be freely reproduced at any time in accordance with the New Zealand Flags, Emblems and Names Protection Act 1981.

  1. Textiles, apart from headscarves or wall hangings, are not regarded as souvenirs within the meaning of these rules.

  2. Containers or receptacles of merchandise may qualify as souvenirs within the meaning of these rules, provided that:

(a) They are permanent in nature, i.e., of metalware, ceramic or other semi-indestructible material, and specifically made for the occasion.

(b) They comply with the requirement of paragraph 2 (b). The name of the manufacturer and content details should appear only on the underside or interior of the container, or on the stopper.

(c) The Royal Emblems reproduced on such containers are confined to:

(i) Photographs or portraits of The Queen and/or The Duke of Edinburgh.

(ii) The Royal Crown, but only in any attendant scheme of decoration.

Note: The Royal Arms or The Duke of Edinburgh’s Arms may NOT be reproduced on containers.

  1. Souvenirs may be manufactured at any time before the visit of The Queen and The Duke of Edinburgh, during the visit and for a period of 3 months after the end of the visit.

  2. Reproductions of the Royal Emblems and portraits mentioned in paragraph 3 above may be used in schemes of decoration for the visit, but NOT in any way which might imply Royal Patronage or Royal Approval of any firm or its products.

  3. (a) The Royal Standard, The Queen’s New Zealand Standard, The Duke of Edinburgh’s Standard or The Queen’s Personal Flag may NOT be flown by anyone other than Her Majesty or His Royal Highness, and may NOT be reproduced on souvenirs or incorporated in any scheme of decoration.

(b) The Royal Cyphers may NOT be reproduced on souvenirs or incorporated in any scheme of decoration.
