Land Declared to be Road, Road Stopped and Taken in Merrivale Settlement

Pursuant to Part VIII of the Public Works Act 1981, and to delegation from the Minister of Lands, the Acting District Manager, Department of Survey and Land Information, Invercargill:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto, to be road and shall vest in the Southland District Council on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to sections 116 and 117, declares those portions of road described in the Second Schedule hereto to be stopped and further declares that:

(i) The portion of road firstly described be amalgamated with the land in certificate of title 9B/46, subject to existing encumbrances.

(ii) The portion of road secondly described be amalgamated with the land in certificate of title 7B/408, subject to existing encumbrances.

(iii) The portions of road thirdly, fourthly and fifthly described be amalgamated with the land in certificate of title 155/146, subject to existing encumbrances.

(iv) The portion of road sixthly described be amalgamated with the land in certificate of title B2/1016, subject to existing encumbrances.

(v) The portion of road seventhly described be amalgamated with the land in certificate of title 6D/972, subject to existing encumbrances.

(c) Pursuant to section 119, declares the land in the Third schedule hereto, to be taken and when so taken, be amalgamated with the land in certificate of title 155/146, subject to existing encumbrances.
