This notice concerns the leasehold interests in the properties at 9, 13 and 15 Pipitea Street, Wellington, and Maori claims under the Treaty of Waitangi Act 1975.
The leasehold interests in the properties at 9, 13 and 15 Pipitea Street, Wellington, are described in legal terms as follows:
No. 9 Pipitea Street—All that parcel of land containing 713 square metres, more or less, situated in the City of Wellington, being part Sections 542 and 543, Town of Wellington, and being all the land in leasehold certificate of title 37C/574 (Wellington Land Registry)
limited as to parcels subject to: (1) Memorandum of extension 905012.1, (2) section 27B of the State-Owned Enterprises Act 1986.
No. 13 Pipitea Street—All that parcel of land containing 202 square metres, more or less, situated in the City of Wellington, being part Section 543, Town of Wellington, and being all the land in leasehold certificate of title 37C/576 (Wellington Land Registry)
limited as to parcels subject to: (1) Memorandum of extension 482206.2, (2) section 27B of the State-Owned Enterprises Act 1986.
No. 15 Pipitea Street—All that parcel of land containing 169 square metres, more or less, situated in the City of Wellington, being part Section 543, Town of Wellington, and being all the land in leasehold certificate of title 37C/575 (Wellington Land Registry)
limited as to parcels subject to: (1) Memorandum of extension 482206.1, (2) section 27B of the State-Owned Enterprises Act 1986.
The leasehold interests in the land were once owned by the Crown. They were transferred to a State-Owned Enterprise under the State-Owned Enterprises Act 1986.
There is a special notice or “memorial” on each of the leasehold certificates of title for the land which provides that, if the Waitangi Tribunal recommends it, the leasehold interests in the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).
The current owner of the leasehold interests in the land, HER MAJESTY THE QUEEN, has applied to the Waitangi Tribunal to have the memorials removed. This has been done under section 8D of the Treaty of Waitangi Act 1975. The application for removal of the memorials has been made to enable the Crown to transfer the leasehold interests to the Wellington Tenths Trust as an “on account” settlement of the trust’s Treaty of Waitangi claim (WAI 145).
ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THESE LEASEHOLD INTERESTS IN LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 17TH DAY OF NOVEMBER 1995.
Section 6 of the Treaty of Waitangi Act 1975 describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington.
If no claim about these leasehold interests in land is made to the Waitangi Tribunal before the 17th day of November 1995, then the Tribunal may recommend that the leasehold interests in land no longer be liable to be resumed by the Crown and returned to Maori ownership under section 27B of the State-Owned Enterprises Act 1986.
