Local Government Act 1974
Terms of Reference for Inquiry into West Coast Regional Council Funding
Pursuant to section 37x of the Local Government Act 1974, the Minister of Local Government requests the Local Government Commission to consider and report on the West Coast Regional Council’s funding situation, identifying:
(a) the West Coast Regional Council’s statutory minimum functions and obligations;
(b) whether these are being fully met and undertaken;
(c) whether these are being undertaken in an efficient and effective manner;
(d) whether the West Coast Regional Council has the capacity to adequately fund those required activities, taking into account all the funding options currently available to it; and
(i) if not, the extent of the funding shortfall, or
(ii) if the Regional Council does have that capacity,
(e) how best it could adequately fund those activities; and
(e) such other matters, including the Region’s socio-economic profile, which in the opinion of the Commission are relevant to the West Coast Regional Council’s ability to fully fund its functions.
The Commission shall consult:
(a) the West Coast Regional Council;
(b) the Buller, Grey and Westland District Councils;
(c) the Departments of Conservation and Internal Affairs and the Office of the Controller and Auditor-General;
(d) other Departments which administer legislation under which the West Coast Regional Council carries out its statutory functions; and
(e) such other individuals and organisations as the Commission considers appropriate.
The Commission shall report to me by 30 September 1995.
