The Treaty of Waitangi Act 1975

State-Owned Enterprises Act 1986

This notice concerns a property formerly used for residence of Post and Telegraph purposes, situated at 21 Bertram Street, Warkworth and Maori claims under the Treaty of Waitangi Act 1975.

The land at 21 Bertram Street, Warkworth is described in legal terms as:

All that parcel of land containing 804 square metres, more or less, being Lot 1, Deposited Plan 136107 and being part Allotment 120, Parish of Mahurangi and being all that land comprised and described in certificate of title 80B/16, North Auckland Registry. Subject to section 27B of the State-Owned Enterprises Act 1986.

The land was once owned by the Crown. It was transferred to a State Owned Enterprise under section 23 of the State-Owned Enterprises Act 1986.

There is a special notice or “memorial” on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).
