Pursuant to sections 20 (1) and 50 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Christchurch, declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired together with the appurtenant right of way and drainage easements created in easement certificate 616618/5 and subject to the drainage easements contained in the said easement certificate and the easement in gross created by transfer 616618/8 for police purposes and shall vest in the Crown on the date of publication of this declaration in the New Zealand Gazette. The land so acquired subject to the easement in gross described in the Second Schedule in favour of The Waimakariri District Council (called ‘the council’).

A right to drain sewage in gross forever under that part of the said land marked “E” on Deposited Plan 66619 with the rights and powers implied in and attaching to the right to drain sewage as set out in the Seventh Schedule of the Land Transfer Act 1952 save that the Crown shall not place any buildings, erections or fences on the servient land and will not at any time, however, do permit or suffer any act whereby the rights, powers, licences and liberties hereby granted to the council may be interfered with or affected.
