Fourth Schedule

Description of Right of Way Easement

  1. The grantee shall not be required or empowered to fence the boundaries of the right of way.

  2. The grantors may fence across the right of way but in so doing shall erect within such fence a farm gate which will permit the passage of vehicles along the said right of way.

  3. The use of the right of way by the grantee shall be restricted to vehicles and personnel under the control and direction of the grantee.

  4. The grantee shall ensure that all farm gates that have been erected to permit passage along the said right of way are closed and latched after each passage of a vehicle belonging to the grantee or under the direction and control of the grantee. The gate from Te Matai Road on to that part of the right of way marked “G” on S.O. Plan 60004 shall be kept locked at all times and a key to the gate shall be under the control of the grantors and a further key under the control of the grantee.

  5. Maintenance of the right of way including the 3 gates supplied by the grantors to a standard sufficient for the purposes of the grantee will be the sole responsibility of the grantee as shall the removal of any slips or fallen trees from the right of way.

  6. Should the right of way interfere with any change of farming practice introduced by the grantors the grantee will co-operate in all reasonable ways with the grantors to alleviate the effects of the interference.

  7. Except as varied herein the rights and powers contained in the Seventh Schedule of the Land Transfer Act 1952, shall apply as if the same were fully set out herein.

Fifth Schedule

South Auckland Land District

Land Over Which Right of Way Easement is Acquired

All those pieces of land, situated in Block VI, Maketu Survey District, being parts of Section 8, Waiari Settlement; as shown marked “D”, “F” and “G” on S.O. Plan 60004, lodged in the office of the Chief Surveyor at Hamilton.

Land Acquired for Road in Western Bay of Plenty District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for road, and shall vest in The Western Bay of Plenty District Council on the date of publication hereof in the New Zealand Gazette.

Road Realignment in Waipa District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares:

(a) Pursuant to section 114, the land described in the First Schedule hereto to be road and vested in The Waipa District Council.

(b) Pursuant to section 116, the pieces of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to section 117 that:

(i) Areas “F” and “G” now known as Sections 2 and 3, S.O. 59904 respectively, shall be amalgamated with the land in certificate of title, Volume 685, folio 158, subject to memorandum of mortgage H. 969209.2, South Auckland Land Registry.

(ii) Area “B”, now known as Section 1, S.O. 59904, shall be amalgamated with the land in certificate of title No. 20A/982, subject to memorandum of mortgage H. 969209.2, South Auckland Land Registry.

First Schedule

South Auckland Land District

2620 square metres, situated in Block XIII, Hamilton Survey District, being part Lot C, D.P. 6985; as shown marked “A” on S.O. Plan 59904, lodged in the office of the Chief Surveyor at Hamilton.

Second Schedule

South Auckland Land District

655 Part Lot C, D.P. 6985; marked “B” on plan.
415 Part Allotment 88, Ngaroto Parish; marked “F” on plan.
20 Part Allotment 88, Ngaroto Parish; marked “G” on plan.
