having carried out a reassessment of anti-dumping duty in respect of imports into New Zealand of certain plasterboard from Thailand and having determined a new anti-dumping duty applicable to those goods, gives the following notice.

N o t i c e

1. Title and Commencement—(1) This notice may be cited as the Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 3, and shall be read together with and deemed part of the notice entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand” dated 21 December 1989 and published in the New Zealand Gazette of 11 January 1990 (hereinafter referred to as the principal notice).

(2) The reassessed anti-dumping duty, set out in the Schedule to this notice, shall apply to imports of the goods specified in the said Schedule with effect from the day after its publication in the New Zealand Gazette.

2. Amendment to anti-dumping duty applicable—The principal notice (as amended by the notice in the New Zealand Gazette of 8 March 1990 entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 1”, and by the notice in the New Zealand Gazette of 18 April 1991 entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 2 (Duty Reassessment)”) is hereby amended by omitting the Schedule and substituting the Schedule to this notice.

3. Consequential revocation—The notice entitled “Final Determination: Dumping Investigation in Respect of Plasterboard From Thailand, Amendment No. 2 (Duty Reassessment)”, and published in the New Zealand Gazette of 18 April 1991, is hereby revoked.

SCHEDULE

Amount of Anti-Dumping Duty

The anti-dumping duty which is to be collected and paid on demand to the Collector in respect of each importation of plasterboard—

Being either standard or foil-backed plasterboard having nominal dimensions of 9 mm or 9.5 mm thickness by 1200 mm width by 2400 mm to 3600 mm length and falling within Tariff items 6809.11.00 and 6809.19.00, when produced by SCT Co Ltd or Thai Gypsum Products Co Ltd, and imported or intended to be imported into New Zealand from Thailand, shall be equal to the amount by which the free-on-board value (being “Customs value” as defined in section 2 (1) of the Customs Act 1966) is less than the following non-injurious free-on-board import prices in respect of standard and of foil-backed plasterboard as follows:

Initiation of Dumping Investigation: Disposable Lighters from Indonesia

Notice is hereby given that, acting pursuant to section 10 (1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, I have initiated an investigation to determine both the existence and effect of the alleged dumping of the goods described and from the country of origin specified in the Schedule to this notice, being satisfied that sufficient evidence has been provided that:

(a) The goods imported or intended to be imported into New Zealand are being dumped; and

(b) By reason thereof material injury to an industry has been or is being caused;

and also being satisfied that the collective output of those New Zealand producers who have, in writing, expressed support for the application constitutes:

(a) Twenty-five percent or more of the total New Zealand production of like goods produced for domestic consumption (assessed during the most recent representative period, being not less than six months); and

(b) More than 50 percent of the total production of like goods produced for domestic consumption (as so assessed) by those New Zealand producers who have, in writing, expressed support for or opposition to the application.

Disposable non-refillable lighters whose fuel is butane, isobutane, propane, or other liquefied hydrocarbon, or a mixture containing any of these.

The goods are currently classified under Tariff Item and Statistical Key 96.13.10.00D of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.
