Advertisement of Application for Order Under Section 209G of Companies Act 1955

Take notice that on 27 March 1995, an application for orders under section 209G of the Companies Act 1955, in respect of Outbound Systems Limited and Shayne Peter Bates was filed in the High Court at Auckland.

The orders sought are:

(a) Against Outbound Systems Limited:

(i) That the company be put into liquidation under the Companies Act 1955.

(b) Against Shayne Peter Bates:

(i) An inquiry as to the loss suffered by the applicant as a result of the actions of Shayne Peter Bates;

(ii) An order that Shayne Peter Bates acquire the applicant’s shares in Outbound Systems Limited and pay compensation for the full amount of loss suffered by the applicant as a result of Shayne Peter Bates’s management of the affairs of Outbound Systems Limited.

(iii) Costs.

The application is to be heard before the High Court at Auckland on 25 May 1995 at 10.00 a.m.

Any person, other than the defendant company, or Shayne Peter Bates who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.
