Easements Acquired in Western Bay of Plenty District
Pursuant to sections 20 and 28 of the Public Works Act 1981 and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement between John Lewis Stanton, orchardist of Te Puke, as grantor and The Western Bay of Plenty District Council, as grantee, to that effect having been entered into, the right of way easement in perpetuity described in the First Schedule hereto (being appurtenant to the land described in the Fourth Schedule hereto) is hereby acquired in connection with water reticulation purposes over the land described in the Third Schedule hereto; the right to convey water by easement in perpetuity described in the Second Schedule hereto (being appurtenant to the land described in the Fourth Schedule hereto) is hereby acquired in connection with water reticulation purposes over land described in the Third Schedule hereto; and further declares that the said easements shall vest in The Western Bay of Plenty District Council on the date of publication hereof in the New Zealand Gazette.

The rights and powers implied in and attaching to a right of way as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right of Way” as if the same were fully set out herein.
Second Schedule
Description of Right to Convey Water Easement
The rights and powers implied in and attaching to a right to convey water easement as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right to Convey Water”, together with the additional rights contained in paragraph 5 of the said Seventh Schedule, as if the same were fully set out herein.
