Reserves Act 1977

Classification of Reserve and Vesting in The Tararua District Council

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator, Hawke’s Bay Conservancy, hereby classifies the reserve described in the Schedule hereto, as a local purpose (gravel) reserve and vests the said reserve in The Tararua District Council in trust for that purpose.

Hawke’s Bay Land District—Tararua District

3.0733 hectares, more or less, being Lot 1, D.P. 13915, situated in Block XII, Tahoraiti Survey District. All transfer 311298.2. Subject to water and pipeline rights created by transfer 224578.

Classification of Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator, Department of Conservation, Hawke’s Bay Conservancy, hereby classifies the reserve described in the Schedule hereto, as Government purpose (facilities associated with the protection of the gannets) reserve, subject to the provisions of the said Act.

Schedule

Hawke’s Bay Land District—Hastings District

All that area in the Hawke’s Bay Land District bounded by a line commencing at the common mean high water springs boundary point of Sections 2 and 3, Block III, Kidnapper Survey District (S.O. 8314) and proceeding generally westerly along the seaward boundary of the aforementioned Section 3, along the northern seaward boundary of Lot 2, Deeds Plan 915 to the intersection with the New Zealand Map Grid line of 2859000m east; thence north along the aforementioned grid line to its intersection with the mean low water springs mark; thence generally easterly along the mean low water springs mark to the intersection with the northerly production of the common boundary of the aforementioned Sections 2 and 3; thence proceeding south along the aforementioned produced line to the commencement point; excluding any islands or rocks contained within the nature reserve in New Zealand Gazette, 1983, page 2023, which may be within the above boundaries. All Gazette notice 629883 (New Zealand Gazette, 1995, page 3009).

Change of Classification of a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator of the Nelson/Marlborough Conservancy of the Department of Conservation, hereby changes the classification of the reserve described in the Schedule hereto, from a local purpose (public hospital) reserve to a local purpose (rest home) reserve.

Marlborough Land District—Marlborough District

7432 square metres, more or less, being Section 1280, Town of Picton. All certificate of title 36/215.

Revocation of a Reservation Over a Reserve Specifying the Manner of Disposal and How Proceeds of Sale Shall be Utilised

Pursuant to the Reserves Act 1977, and a delegation from the Minister of Conservation, the Regional Conservator of the Wellington Conservancy of the Department of Conservation, hereby revokes the reservation as a local purpose reserve (segregation strip) over the land described in the Schedule hereto, and further declares that the said land may be disposed of by The Kapiti Coast District Council in such manner, and at such price and conditions as the council shall determine, the proceeds from such sale to be paid into the general funds of council.

Schedule

Wellington Land District—Porirua City

1290 square metres, more or less, being Lot 2, D.P. 63207, situated in Block III, Kapiti Survey District. Vested on D.P. 63207.

Resource Management Act 1991

Vesting of Land in the Ports of Auckland Limited

Pursuant to section 355 (3) of the Resource Management Act 1991, the Minister of Conservation vests the land described in the Schedule hereto in the Ports of Auckland Limited, subject to a conservation covenant in terms of section 77 of the Reserves Act 1977, securing the right of public access to the conservation area and to the Western Viaduct being entered into in favour of The Auckland City Council over the area shown as “B”, being part of Lot 2, D.P. 164899, all certificate of title 77A/405, and more particularly described in clause 8 (a) of a Consent Order, dated 22 April 1992 and varied on 4 February 1994, relating to an appeal in terms of the America’s Cup Planning Act 1989.
