6 Exercise of Discretion

6.1 If you determine that a particular immediate needs exists, and that an advance would best meet the immediate needs of the beneficiary, you are to have regard to the matters set out in clause 6.3 in exercising your discretion whether to make an advance.

6.2 In the exercise of your discretion, if you determine that a beneficiary has exceptional circumstances, you may, after having regard to the matters set out in clause 6.3—

(a) make an advance where the beneficiary and his or her spouse has cash assets or income exceeding the limits set out in clause 2.3, or

(b) make an advance in excess of any limit set out in clause 4, or

(c) recover an advance at a lower rate than set out in clause 5.

6.3 The matters referred to in clause 6.1 and 6.2 are—

(a) the beneficiary’s ability to repay the advance,

(b) whether the beneficiary could reasonably have been expected to have made provision for the particular immediate need,

(c) the extent to which not making an advance, or an advance in excess of the limit, or requiring recovery at the rate set out in clause 5, would—

(i) worsen the beneficiary’s position, or

(ii) increase or create any risk to the life or welfare of the beneficiary or the beneficiary’s spouse or dependent children, or

(iii) cause serious hardship to the beneficiary, or the beneficiary’s spouse or dependent children,

(d) any other matters that you consider to be relevant, in the circumstances of the particular case.

International Air Services Licensing Act 1947

Notice of Application for an International Air Service Licence

Pursuant to section 7 of the International Air Services Licensing Act 1947, notice is hereby given that Polynesian Limited of Apia, Western Samoa, the successor to Polynesian Airlines (Holdings) Limited, has applied for an international air service licence to permit the airline to carry on a scheduled air service for the carriage of passengers, cargo and mail from Western Samoa by various routes to Auckland and Wellington, and beyond.

Further details of this proposal may be obtained from the Secretary for Transport, Ministry of Transport, P.O. Box 3175, Wellington.

Any person or organisation wishing to make representations relating to this application must forward those representations in writing to reach me on or before 3 November 1995.

Transport Act 1962

The Traffic (Rodney District) Notice No. 1, 1995

Pursuant to the Transport Act 1962, and to a delegation from the Minister of Transport, I, Judith Olga Stack, Secretary for Transport, give the following notice:

This notice may be cited as the Traffic (Rodney District) Notice No. 1, 1995.

The area and roads specified in the First Schedule are declared to be closely populated localities for the purposes of section 52 of the Transport Act 1962.

The areas and roads specified in the Second Schedule are declared to be 70 kilometres an hour speed limit area pursuant to regulation 21 (2) of the Traffic Regulations 1976.

So much of the Traffic (Rodney District) Notice No. 1, 1993, signed on the 5th day of November 1993*, which relates to roads in the Schedules below and so much of the Traffic (Rodney District) Notice No. 1, 1990, signed on the 30th day of March 1990†, which relates to roads in the Schedules below, both issued pursuant to section 52 of the Transport Act 1962 and regulation 21 (2) of the Traffic Regulations 1976, are revoked.

FIRST SCHEDULE

SITUATED within Rodney District at Orewa:

The First Schedule of the Traffic (Rodney District) Notice No. 1, 1990, as amended:

(a) by omitting the words “thence easterly, generally, along the northern side of Hillcrest Road to a point 300 metres measured westerly, generally, along the said road from Lancelot Road; thence southerly, generally, by a right line across Hillcrest Road from its northern side to its southern side; thence southerly, generally, to the northern terminating point of Ngarere Views; thence southerly, generally, along the western side of Ngarere Views to its intersection with West Hoe Road to a point 40 metres measured westerly, generally, along West Hoe Road from Centreway Road; thence southerly, generally, by a right line across West Hoe Road from its northern side to its southern side; thence south-westerly, generally, by a right line to the western terminating point of Florence Avenue”.

(b) and substituting the following words “thence southerly, generally, to a point 480 metres measured westerly, generally, along West Hoe Road from Ngarere Views; thence southerly, generally, by a right line across West Hoe Road from its northern side to its southern side; thence south-easterly, generally, by a right line to the western terminating point of Florence Avenue”.

At Albany:

Mahoenui Valley Road; from Coatesville Riverhead Road to a point 400 metres measured easterly, generally, along the said road from Coatesville Riverhead Road.

At Sandspit:

Brick Bay Road.

At Snells Beach:

Mahurangi East Road; from a point 250 metres measured northerly, generally, along the said road from Governor Grey Road to a point 220 metres measured southerly, generally, along the said road from Alexander Road.
