Notice Pursuant to Part VIIA of the Property Law Act 1952

The Hongkong and Shanghai Banking Corporation Limited hereby gives notice pursuant to Part VIIA of the Property Law Act 1952 that:

(a) Being the mortgagee under memorandum of mortgage No. B246143.4 (Wellington Registry), given by David Barratt and Pamela Ann Barratt;

(b) Having served a default notice under section 92 of the Property Law Act 1952 and having a right to enter into possession of the mortgaged property, 41 Chilton Drive, Paraparaumu, described in certificate of title 32A/483;

(c) Being satisfied that the mortgagor had vacated the mortgaged property; and

(d) Having good cause to believe that the mortgaged property had suffered damage and would suffer further damage, therefore seriously undermining the mortgagee's security,

The mortgagee peaceably entered into possession of the mortgaged property on the 20th day of September 1995.

Proposed Release of Deposit

Pursuant to the Insurance Companies’ Deposits Act 1953

Gerling Global Reinsurance Company (herein called “the company”), has given notice to the public trustee that it has ceased to carry on the business of insurance in New Zealand and that it proposes to withdraw, pursuant to section 19 of the Act, the deposit which has been made by it with the public trustee.

The public trustee therefore gives notice, pursuant to section 19 (3) of the Act, that being satisfied that all liabilities of the company in New Zealand in respect of such insurance business have been fully liquidated or provided for, he proposes to release to the company on or after 30 November 1995, the amount deposited with him by the company.

Any objections to the release of the amount deposited should be lodged with the public trustee at the Public Trust Office, 117–125 Lambton Quay, Wellington 1, on or before 30 October 1995.
