Canterbury Region—Notification of a Regional Petrol Tax

Pursuant to section 200D of the Local Government Act 1974, as enacted by the Local Government Amendment Act (No. 2) 1992, The Canterbury Regional Council notifies that the council has from midnight 18 October 1995, levied an increased regional petrol tax for the purposes of funding passenger services.

The rate of tax is 0.84 cents, plus G.S.T., per litre of petrol sold.

The area of the Canterbury region to which the tax applies is the area of The Christchurch City Council and the area of the Lyttleton/Mount Herbert Ward of The Banks Peninsula District Council.

The Treaty of Waitangi Act 1975

State-Owned Enterprises Act 1986

This notice concerns a property formerly used for residential post office purposes, situated at 45 Pulham Road, Warkworth, and Maori claims under the Treaty of Waitangi Act 1975.

The legal description of the land at 45 Pulham Road, Warkworth, is given in the certificate of title 77D/393 (North Auckland Registry) as:

All that parcel of land containing 809 square metres, more or less, being Lot 22, Deeds Plan W66 (1) and being part Allotment 68, Parish of Mahurangi, subject to fencing covenant in Conveyance 199393 (R 165/447), section 27B of the State-Owned Enterprises Act 1986, section 3 of the Petroleum Act 1937, section 8 of the Atomic Energy Act 1945, section 3 of the Geothermal Energy Act 1953, sections 6 and 8 of the Mining Act 1971 and sections 5 and 261 of the Coal Mines Act 1979.

The land was once owned by the Crown. It was transferred to a State-Owned Enterprise under section 23 of the State-Owned Enterprises Act 1986.

There is a special notice or “memorial” on the certificate of title for the land which provides that, if the Waitangi Tribunal recommends it, the land shall be resumed by the Crown and returned to Maori ownership (see sections 27A and 27B of the State-Owned Enterprises Act 1986).

The current owners of the land, GRAEME PAUL GARNER and MIRANDA MARGARET BUXTON, have applied to the Waitangi Tribunal to have this notice removed. This has been done under section 8D of the Treaty of Waitangi Act 1975.

ANY MAORI PERSON WHO CONSIDERS THAT THEY, OR ANY GROUP WHICH THEY BELONG TO, HAS A CLAIM TO MAKE TO THE WAITANGI TRIBUNAL ABOUT THIS LAND, SHOULD SUBMIT THEIR CLAIM TO THE WAITANGI TRIBUNAL BEFORE THE 22ND DAY OF DECEMBER 1995.

Section 6 of the Treaty of Waitangi Act 1975, describes what a claim is. Claims may be posted or sent to the Registrar, Waitangi Tribunal, Seabridge House, 110 Featherston Street (P.O. Box 5022), Wellington.

If no claim about this land is made to the Waitangi Tribunal before the 19th day of December 1995, then the Tribunal may recommend that the land no longer be liable to be resumed by the Crown and returned to Maori ownership under section 27B of the State-Owned Enterprises Act 1986.
