Notice is hereby given that following the filing of a resolution as to solvency of the above-named company on the 21st day of December 1994 by entry in its minute book, signed in accordance with section 364 of the Companies Act 1955, passed a special resolution for the winding up and liquidation of the company pursuant to section 211 (2) (a) of the Companies Amendment Act 1993.

Notice of Application for Appointment of Liquidator

Take notice that I the undersigned liquidator of the above-named company have applied to the High Court for the following orders:

1. An order appointing John Maurice Wilson and James Bruce Alfred McAlister as liquidators in place of the official assignee.

2. An order that the official assignee’s fees and costs to date be payable out of the assets of Exeter Developments Limited (in liquidation) and be in accordance with the Companies Act 1955 Liquidation Regulation 1994 and be a first charge on any funds received by a newly appointed liquidators or liquidator.

3. An order that the liquidators (if appointed) be entitled to exercise their powers individually pursuant to section 212 of the Companies Act 1955.

4. That pursuant to section 251 (1) of the Companies Act 1955 the liquidators be entitled to charge reasonable remuneration for carrying out their duties and exercising their powers on the basis of an hourly charge for work done by the liquidators or any partner or employee of the liquidators at rates appropriate to such persons carrying out the work.

5. Such further or other order as to the Court seems proper.

That by order of Master Hansen the said application will be heard at the High Court at Christchurch on the 13th day of February 1995 at 10.00 a.m.

Further by order of Master Hansen any creditor who intends to appear whether in person or by counsel shall file in the High Court Registry, Christchurch:

(a) A notice of intention to appear in writing and any representation affidavits or submission in writing no later than 7 days before the hearing date and

(b) Serve copies of such representations affidavits or submissions on the official assignee no later than 7 days before the hearing date.
