District Anglers (Southland Fish and Game Region) Notice 1990, Amendment No. 4

Pursuant to section 26R (3) of the Conservation Act 1987 the Southland Fish and Game Council amends the District Anglers (Southland Fish and Game Region) Notice 1990, supplement to the New Zealand Gazette, 1990, No. 151, pages 3221–3222.

  1. Title and Commencement—(1) This amending notice may be cited as the District Anglers (Southland Fish and Game Region) Notice 1990, Amendment No. 4, and shall be read together with and deemed part of the District Anglers (Southland Fish and Game Region) Notice 1990 (hereinfater referred to as the “principal notice”).

(2) This amendment notice shall come into force on the 1st day of October 1994.

  1. Authorised Lures and Baits—(1) Clause 10 of the principal notice is revoked and replaced with the following:

  2. Authorised lures and baits—(1) Subject to subclause 2 of this clause no licence holder shall fish for sports fish with any bait or lure other than an artificial frog or mouse, artificial or natural fly, insect, worm, crustacean, mollusc or fish in the following waters:

(a) the Mataura and Waikaka Rivers and all of their tributaries and all waters of the region that drain to the sea between Fortrose and the Brothers Point;

(b) Waituna Lagoon and its tributaries;

(c) the Oreti River and its tributaries downstream of Rocky Point, 1km west of Mossburn;

(d) the Waimatuku River and all its tributaries;

(e) the Aparima River and its tributaries downstream of the Hamilton Burn Confluence; the Hamilton Burn downstream of the Otautau-Mossburn highway;

(f) all waters draining to the sea between and including the Pourakino River and the Waimeamea River;

(g) the lower Waiau River and its tributaries (including the Holly Burn) except for the Wairaki River above the West Arm - Tiwai transmission lines; the Borland Burn and the Monowai River;

(h) The Mararoa River between the Key Bridge and Mararoa Weir.

(2) No licence holder when fishing for sports fish shall have in his or her possession or in his or her control any lure or bait other than artificial bait in all other waters of the region.

(3) Subject to clause 10 (4) no licence holder when fishing for sports fish shall have in his or her possession or under his or her control any lure or bait other than an artificial fly in the Upukerora and Eglinton Rivers and their tributaries.

(4) Junior or child free licence holders may fish in the Upukerora River downstream of the SH94 Bridge with any artificial bait.

  1. Daily limit bag—(1) Clause 11 (2) (f) of the principal notice is revoked and replaced with the following:

(f) the Borland River; and the Monowai River.

  1. Minimum size to be taken—(1) Clause 12 of the principal notice is revoked.

Pursuant to section 7 (1) of the Conservation Act 1987, the Minister of Conservation and the Minister of Lands, being the Minister responsible for the Department of State that has control of the land described in the Schedule hereto, jointly declare that the land is held for conservation purposes.

Declaring Land to be Held for Conservation Purposes Together With a Declaration That an Area Become a Recreation Reserve

Pursuant to section 7 (1) of the Conservation Act 1987, the Minister of Conservation and the Minister of Lands, being the Minister responsible for the Department of State that has control of the land described in the First Schedule hereto, jointly declare that the land is held for conservation purposes and, pursuant to section 8 (1A) of the Act, the Minister of Conservation further declares that the conservation areas described in the Second Schedule hereto, shall hereafter be set apart as a reserve, subject to the Reserves Act 1977, and classified as a recreation reserve, subject to the provisions of the latter Act and shall hereafter be so held.
