charged with a breach of this clause if that licence holder proves that he or she was netting for indigenous fish in accordance with the provisions of any regulations or notices in force in that behalf.

  1. Prohibition on possession or control of spear gun—(1) No licence holder shall, when taking or attempting to take or when in possession of, any sports fish, be in possession of or be in control of, any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.

(2) Where any licence holder is charged with an offence under subclause (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in the defendant’s possession or under the defendant’s control was not used in the taking of the sports fish.

(3) In this clause the term “explosive” has the same meaning as in the Explosives Act 1957.

  1. Authorised lures and baits—No licence holder shall fish for sports fish with any bait or lure other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)).

  2. Daily limit bag—(1) No licence holder shall on any one day take, kill or have in possession more than 6 sports fish.

(2) Notwithstanding subclause (1) of this clause, no licence holder shall on any one day take or have in his possession more than:

(a) 6 sports fish taken from Lake Coleridge of which no more than 4 shall be trout;

(b) 2 quinnat salmon taken from any other water;

(c) 4 trout taken from any other water.

(d) 1 splake from Lake Letitia.

(3) No licence holder shall continue to fish for sports fish on any day on which he has already killed 6 sports fish.

(4) It shall be permissible to make up the difference between a lesser limit bag prescribed in one place and a higher limit bag prescribed in another place.

(5) Notwithstanding subclauses (1), (2) and (4) of this clause, no licence holder shall on any one day take and kill or have sports fish in their possession, from:

(a) Lake Marymere (a special catch and release zone); all sports fish caught in this water must be immediately released with as little injury as possible back into the waters from which they were taken.

  1. Minimum size to be taken—(1) No licence holder shall take or have in his possession any trout or salmon which does not exceed 25 cm in length.

(2) Every licence holder taking a trout or salmon which does not exceed the specified length, or who wishes to release the fish for whatever reason, shall immediately return it with as little injury as possible into the water from which it was taken.

  1. Revocation—The notice published in the supplement to the Gazette, 1990, No. 151, pages 3213–3215 titled District Anglers (North Canterbury Fish and Game Region) Notice 1990, and Amendments No. 1, No. 2, No. 3 and No. 4, are hereby revoked.

District Anglers (Central South Island Fish and Game Region) Notice 1992 Amendment No.2

Pursuant to section 26R (3) of the Conservation Act 1987, the Central South Island Fish and Game Council amends the District Anglers (Central South Island Fish and Game Region) Notice 1992, supplement to the New Zealand Gazette, 1992, No. 136, pages 2915–2918.

Notice

  1. Title and commencement—(1) This notice may be cited as the District Anglers (Central South Island Fish and Game Region) Notice 1992, Amendment No. 2 and shall be read together with and deemed part of the District Anglers (Central South Island Fish and Game Region) Notice 1992 (herein referred to as the “principal notice”).

(2) This amending notice shall come into force on the 1st day of October 1994.

  1. Interpretation—(1) Clause 2 (1) of the principal notice is amended by deleting the word “Fishing” and its definition and substituting with the following:

Fishing

(a) Means the catching, taking, or harvesting of freshwater fish; and

(b) Includes—

(i) Any other activity that may reasonably be expected to result in the catching, taking, or harvesting of freshwater fish;

(ii) Any attempt to catch, take, or harvest freshwater fish;

(iii) Any operation in support of, or in preparation for, any activity described in this definition.
  1. Closed Season—(1) Clause 4 (1) (b) of the principal notice is amended by inserting the following words “or in tributaries to Lakes Pukaki and Tekapo” after “said lakes, tarns, and rivers”.

  2. Authorised Tackle—(1) Clause 5 (7) of the principal notice is renumbered 5 (7) (a).

(2) Clause 5 (7) of the principal notice is amended by adding the following paragraph:

“(b) No licence holder shall continue to fish on any day after having foul hooked three sportsfish, even though any such sportsfish have been returned immediately in accordance with the previous clause 5 (7) (a).”

  1. Authorised Lures and Baits—(1) Clause 9 (2) (b) of the principal notice is amended by deleting the word “Otamatapaio” and substituting “Otematapaio”.

  2. Daily Bag Limit—(1) Clause 10 (1) of the principal notice is amended by deleting the word “take”.

(2) Clause 10 (2) of the principal notice is amended by deleting the word “take” and substituting “kill”.

(3) Clause 10 (3) of the principal notice is amended by inserting the words “or she” between the words “he” and “has”.

(4) Clause 10 (3) of the principal notice is amended by deleting the words “taken or”.

  1. Minimum Size to be Taken—(1) Clause 11 (1) of the principal notice is amended by deleting the words “take or have in his or her possession” and substituting “be in possession of”.
