agreement to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for road, and pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 60 and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to section 114, declares the land described in the Second Schedule hereto, to be road and, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway No. 60 and shall remain vested in the Crown.

(c) Pursuant to section 116 (1), declares the portion of road described in the Third Schedule hereto, to be stopped.

Land Acquired for Road

All those pieces of land situated in Block II, Waitapu Survey District, described as follows:

Land Declared Road

All those pieces of land situated in Block II, Waitapu Survey District, described as follows:

498 Crown land reserved from sale, pursuant to section 58 of the Land Act 1948: coloured orange on plan.
215 Part Onekaka stream bed: coloured sepia on plan.
215 Crown land reserved from sale, pursuant to section 58 of the Land Act 1948: coloured blue on plan.

As shown coloured as above mentioned on S.O. Plan 10394, lodged in the office of the Chief Surveyor at Nelson.


Third Schedule

Nelson Land District—Tasman District

Road Stopped

731 square metres, situated in Block II, Waitapu Survey District, adjoining or passing through part Lot 1, D.P. 1315 and part Section 235, Takaka District, as shown coloured green on S.O. Plan 10394, lodged in the office of the Chief Surveyor at Nelson.

Pursuant to section 114 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Nelson, declares the land described in the Schedule hereto, to be road and, pursuant to section 60 (2) of the Transit New Zealand Act 1989, shall form part of State Highway 6 and shall remain vested in the Crown.

State-Owned Enterprises Act 1986

Land Vested in Landcorp Property Limited

Pursuant to section 24 (1) of the State-Owned Enterprises Act 1986, and to an authorisation dated 15 May 1992, from the Ministers of Finance and State-Owned Enterprises, the Director (Statutory), Department of Survey and Land Information, hereby gives notice as follows:

N o t i c e

  1. Title—This notice may be cited as the Landcorp Property Limited Vesting Notice 1994 No. 1.

  2. Application—(1) This notice applies to all the land described in the Schedule to this notice, saving and excepting:

    (a) The bed of any lake whose bed has an area of 8 hectares or more.
    (b) The bed of any river whose bed has an average width of 3 metres or more.
    (c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.

    (2) In subclause (1) of this clause, the terms “bed”, “lake” and “river” have the meanings assigned to them by section 2 (1) of the Resource Management Act 1991.

  3. Vesting—Subject to section 24 of the Conservation Act 1987, the land to which this notice applies shall vest for an estate in fee simple in Landcorp Property Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington and being a State enterprise within the meaning of section 29 (1) of the State-Owned Enterprises Act 1986) on the 27th day of January 1994,

    (i) Together with the appurtenant rights (if any) described in the Schedule to this notice, but,
    (ii) Subject to the rights, interests and encumbrances (if any) to which it is described in the Schedule to this notice as being subject.
