The Resource Management (Approval of New Zealand Public Radio Limited as Requiring Authority) Notice (No. 1) 1994

Pursuant to sections 167 and 420 (6) of the Resource Management Act 1991, the Minister for the Environment, hereby gives the following notice:

Notice

1. Title and commencement—(1) This notice may be cited as the Resource Management (Approval of New Zealand Public Radio Limited as Requiring Authority) Notice (No. 1) 1994.

(2) This notice shall come into force on the 28th day after the date of its publication in the New Zealand Gazette.

2. Interpretation—(1) In this notice, unless the context otherwise requires—

(a) “Radiocommunication facility” means any mast, pole, aerial, tower, antenna dish, fixed radio station, radio apparatus or other structure, facility or apparatus intended for, associated with, or ancillary to, effecting radiocommunication;

(b) “Fixed radio station”, “radio apparatus” and “radio communication” have the same meaning as in section 2 (1) of the Telecommunications Act 1987;

(c) “Network” means the system of radiocommunication facilities which New Zealand Public Radio Limited now operates, or may in future operate, for the purpose of effecting radiocommunication.

(2) In this notice, any reference to an enactment shall be deemed to include a reference to all subsequent enactments passed in amendment or substitution for that enactment.

3. Approval as requiring authority in respect of every project or work with existing designation—New Zealand Public Radio Limited is hereby approved as a requiring authority under section 167 of the Resource Management Act 1991, for every project or work in respect of which—

(a) A designation was, on 1 October 1991, deemed to be included in a district plan by virtue of section 420 (2) of that Act; and

(b) New Zealand Public Radio Limited is, by virtue of that section of that Act, deemed to be the requiring authority.

4. Approval as requiring authority in respect of other projects or works—New Zealand Public Radio Limited is hereby approved as a requiring authority under section 167 of the Resource Management Act 1991 in respect of the following projects or works—

(a) any radiocommunication facility of its network in respect of any site of which New Zealand Public Radio Limited (or any of its subsidiary companies as defined in the Companies Act 1955) is an owner or holder of any other estate or interest; and

(b) the operation, erection, installation, maintenance, replacement, alteration, improvement, and other use of land (within the meaning of section 9 (4) of the Resource Management Act 1991) in respect of any such radiocommunication facility.

Approval as requiring authority in respect of network utility operation—(1) New Zealand Public Radio Limited is hereby approved as a requiring authority under section 167 of the Resource Management Act 1991, in respect of the particular network utility operation described in subclause (2) of this clause.

(2) The particular network utility operation for which this approval is granted is—

(a) any radiocommunication facility of its network in respect of any site of which New Zealand Public Radio Limited (or any of its subsidiary companies as defined in the Companies Act 1955) is or may, at any time, become an owner or holder of any other estate or interest; and

(b) the operation, erection, installation, maintenance, replacement, alteration, improvement, and other use of land (within the meaning of section 9 (4) of the Resource Management Act 1991) in respect of any such radiocommunication facility.
